Compliance requirements
A bidder must be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of the duty of integrity or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; of enabling unlawful employment of a foreign national or breaches of the conditions for employing foreign nationals in Estonia, including paying less than the statutory wage; or of unlawful child labour or human trafficking. A bidder with outstanding national tax, payment or environmental charges, or tax or social security contribution debts under the law of its country of establishment, is also subject to mandatory exclusion.
The contracting authority may exclude a bidder for materially or persistently breaching important terms of a previous public contract where this resulted in termination, withdrawal, a price reduction, compensation or a contractual penalty. It may also exclude a bidder that has provided false information about meeting qualification requirements or has failed to provide requested information or documents. Participation is prohibited for undertakings established in Russia or Belarus.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to this procurement during the 60 months preceding the start of the procurement. At least one contract must have had a value of EUR 40,000 or more, excluding VAT. Submit a list stating each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address), and the procurement reference number where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant expense.
Before bids are opened, the bidder must have registered in Elektrilevi’s partner portal (EPP) a person authorised to perform the required switching operations and a person responsible for the work operation. For this low-voltage procurement, at least low-voltage switching rights are required. The switching-authorised person must be qualified for the relevant operations in the 0.22–1 kV network. The responsible person’s rights must be obtained in accordance with the applicable Elektrilevi instructions.
The bidder must also have an electrical works manager with valid A-level competence and/or a qualification of at least level 6 under the Professions Act. The manager must hold the relevant evidence when bids are submitted and be registered in EPP before bids are opened.
The bid must comply with all procurement documents; conditional bids or bids containing additional conditions are not permitted. Submit the price using the required price table and complete every unit-price field. The bid must also take account of the completion instructions for Elektrilevi management-system document V178. Provide the name, position and contact details of the contract signatory or signatories and a contact person for contract matters. If the signatory’s authority does not arise from the articles of association, include a power of attorney. Identify and justify any information claimed as a trade secret; the bid price and other specified evaluation-related figures may not be designated as trade secrets. The bidder must confirm that its place of residence or establishment is not in Russia or Belarus and that materials, equipment and goods used in the works are not produced in or sourced from those countries; origin certificates may be requested.
