Compliance requirements
The bidder must confirm that no mandatory exclusion grounds apply. These include relevant convictions of the bidder or persons with authority to represent, manage or control it for participation in a criminal organisation, breach of duty, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the unlawful employment of foreign nationals or breaches of their employment conditions, including underpayment; and unlawful child labour or human trafficking. Exclusion also applies where the bidder has outstanding state taxes, charges or environmental fees, or tax or social security contribution debts under the law of its country of establishment.
The contracting authority may also exclude a bidder for a serious or persistent breach of an earlier public contract that resulted in termination, withdrawal, a price reduction, compensation or a contractual penalty, or for providing false information about meeting qualification requirements or failing to submit required information or supporting documents. The bidder must confirm that these discretionary grounds do not apply. Businesses established in Russia or Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have been worth at least EUR 40,000 excluding VAT. The bidder must submit a list showing each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address), and the procurement reference number where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost.
The bidder must also have, registered in Elektrilevi’s partner portal before tenders are opened, a person with the required switching rights for the work. For work involving only 0.22–1 kV low-voltage switching, low-voltage switching rights are required; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side. A person responsible for the work operation must also be registered in the portal before tenders are opened. The bidder must have an electrical works manager with valid A-level competence and/or a qualification of at least level 6 under the Estonian Professions Act, supported by evidence at the time of tender submission and registered in the portal before tenders are opened.
The tender must include a price table in the prescribed format, with every unit-price field completed. Conditional tenders or tenders containing additional conditions are not permitted. The bidder must confirm compliance with the procurement documents, provide the contract signatory’s name, position, contact details and proof of authority where necessary, and name a contract-performance contact person. Materials, equipment and goods used in the works, including components, must not originate from or be produced in Russia or Belarus; the contracting authority may request certificates of origin.
