Compliance requirements
The bidder must confirm that none of the exclusion grounds under the cited procurement law provisions apply. These cover serious criminal convictions involving the bidder or its relevant managers or representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, and child labour or human trafficking; unpaid taxes or social security contributions; enabling the unlawful employment of a foreign national; and international sanctions. The bidder must provide the names and personal identification codes of any persons authorised to represent, control or make decisions for it who are not identifiable from the commercial register, or confirm that there are no such persons.
Qualification criteria and exclusion grounds
The bidder must provide a team of distinct, non-overlapping responsible persons: (1) a construction works manager with at least a valid Level 7 certified heating, ventilation and refrigeration engineer qualification, including the additional competence to manage construction of cooling systems, or an equivalent qualification; (2) at least four refrigeration mechanics, each with at least a valid Level 4 qualification or equivalent; (3) a design works manager with at least a valid Level 7 certified heating, ventilation and refrigeration engineer qualification, including the additional competence to design indoor climate systems, or an equivalent qualification; and (4) an electrical works specialist with at least valid B-level electrical competence or equivalent. The bidder must also appoint a project manager who has completed Siemens Desigo CC and Siemens Desigo XWorks training and has, as a contractor’s project manager, managed at least two building automation construction, renovation or design projects during the seven years before the tender notice deadline. Submit the required personnel details and qualification evidence; foreign qualifications must be supported by copies of the relevant documents. Submit both training certificates and the project manager’s experience details on the prescribed form.
During the 60 months before publication of the contract notice, the bidder must have completed at least two contracts involving the supply, installation and commissioning of building cooling equipment. The portion completed during that reference period must be worth at least EUR 100,000 excluding VAT for each contract. Provide the required contract details, including scope, period, value and client contact details, using the prescribed form.
The bidder must also have properly completed at least two contracts during the 60 months before the notice deadline involving building automation construction and/or reconstruction works. Provide the prescribed contract details and two client confirmations of proper completion; handover and acceptance certificates alone are not accepted as client confirmations.
The bidder or its subcontractor must hold a valid permit, where required by the law of its country of establishment, for handling products, equipment or systems containing fluorinated greenhouse gases or their alternatives. Foreign bidders must provide a competent authority’s proof of the permit when required. If the bidder relies on another entity’s qualifications or experience, that entity must agree to participate directly in the relevant part of the contract; provide the prescribed consent and identify the subcontractor. Joint bidders relying on one another’s resources must state each party’s share and nature of the contract work.
The offer must be unconditional and comply with the tender documents. Submit the price in the specified structure and the prescribed price form, whose total must also be entered in the relevant price schedule. Confirm environmentally responsible performance, including sorting and recycling waste and using environmentally friendly equipment where possible. Where an equivalent is offered, explain the equivalence and provide supporting evidence. Joint bidders must appoint an authorised representative. Identify and justify any claimed trade secrets; the price and other specified evaluation figures may not be designated as trade secrets. If a subcontractor acts as project manager, include the prescribed commitment to participate in contract performance.
