Compliance requirements
The bidder must confirm that neither the bidder nor its management, supervisory bodies, authorised representatives or controlling persons is subject to exclusion grounds. These include final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking; breaches of tax or social security payment obligations; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation or comparable proceedings; suspension of business activities; serious professional misconduct; agreements restricting competition; conflicts of interest; involvement in preparing the procurement in a way that creates an unfair advantage; serious or repeated breaches of previous public contracts; false or misleading information, failure to provide required information or documents, and attempts to obtain confidential information or improperly influence the contracting authority. The bidder must also confirm compliance with national exclusion grounds concerning unlawful employment of foreign nationals, international sanctions and convictions for tax offences. Where applicable, the bidder must describe the circumstances, provide the requested evidence and explain any reliability-restoration measures. The bidder must confirm that taxes and social security contributions are duly paid. The bidder must also confirm that subcontractors or suppliers representing more than 10% of the contract value are not Russian persons or entities, entities more than 50% owned by them, or persons acting on their behalf or instructions. A tender based on which the resulting contract would be void under applicable sanctions law will be rejected.
Qualification criteria and exclusion grounds
The bidder must be registered in the relevant business register in its country of establishment and, where applicable, provide evidence of registration. For this catering service, the bidder must be recognised by the Agriculture and Food Board as a retail and catering establishment and have the corresponding registration in the Register of Economic Activities. The bidder’s net turnover in the last completed financial year must be at least EUR 30,000 excluding VAT. Upon request, the bidder must provide annual-account extracts or other evidence of turnover, unless the information is publicly available to the contracting authority from the Estonian business register. The bidder must maintain professional liability insurance valid throughout the contract period, with coverage of at least EUR 30,000, and must confirm that the required financial resources are available or obtainable. During the 36 months preceding the start of the procurement, the bidder must have completed at least one catering-service contract lasting at least 12 months and involving regular provision of breakfast, lunch or dinner to at least 30 people. The reference list must include the contracting party’s name and contact details, a description of the service including the number of people served, the contract dates and period, and the relevant value or completed portion. The contracting authority may contact the other contracting party for additional information. The tender must comply with all tender documents, may not be conditional, and must follow the required price-submission structure. The bidder must submit a three-day sample menu showing each meal, its name and quantity in grams, in accordance with the technical description. The bidder must have a clean and legally compliant catering venue suitable for eating, accommodating at least 30 people, located within a 500-metre radius of the Defence League School at Keskuse tee 2, Alu, 79601 Rapla County. Staff providing the service must hold valid food-handler health certificates throughout contract performance, have the necessary professional knowledge and skills, and be able to communicate in Estonian at the level required for service delivery. In a joint tender, the bidders must appoint an authorised representative and submit the relevant power of attorney.
