Compliance requirements
The bidder will be excluded if the bidder or a person authorised to represent, direct or control it has been convicted of participation in a criminal organisation, breach of integrity obligations or a corrupt act, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the illegal employment of foreign nationals or breaches of conditions for their employment in Estonia, including underpayment; or unlawful child labour or human trafficking. A bidder with overdue state taxes, duties or environmental charges, or tax or social security contributions due under the law of its country of establishment, will also be excluded. The bidder will be excluded if awarding the contract would breach an international sanction or a sanction imposed by the Government of Estonia.
The bidder must confirm that none of these grounds applies. A foreign bidder must provide the required criminal-record certificate or equivalent evidence and a certificate from the competent authority confirming that the relevant tax or contribution debts do not exist. If the required documents are not issued or do not cover all the circumstances, equivalent declarations or evidence may be provided. Sanctions-related grounds are checked on the basis of the bidder’s declaration, although the contracting authority may request further evidence where there is a justified doubt.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or an equivalent register where required by the law of its country of establishment. Foreign bidders must provide a valid registration certificate or equivalent evidence; the contracting authority will check the details of bidders registered in Estonia itself.
The bidder, or the subcontractor that will actually transport the waste, must hold a valid waste-management registration or other authorisation by the submission deadline to transport the relevant non-hazardous and hazardous waste in Ida-Viru County. The authorisation must cover waste codes 10 01 99; 10 01 97*; 15 01 06; 15 02 03; 17 04 05; 17 05 04; 17 06 04; 17 09 04; 19 09 01; 19 09 05; and 20 03 03. Code 10 01 97* is hazardous waste. If the authorisation details are not freely accessible to the contracting authority, the bidder must provide a copy of the registration, permit or equivalent document.
The service must be performed using a dump truck with a payload capacity of up to 5 tonnes, a maximum overall height of 2.8 metres and a manipulator. The bidder must provide a vehicle description stating its make, model, registration number, payload capacity and height, and confirming that it has a manipulator.
Subcontracting is permitted. If subcontractors are planned, the bidder must identify those known at the time of submission and state the size and nature of the work to be subcontracted. Any subcontractor whose authorisation is relied upon must be named in the bid and must actually perform the part of the contract for which that authorisation is required. If relying on another undertaking’s resources, the bidder must identify that undertaking and provide acceptable evidence that the resources will be available for contract performance. The bid must include the completed pricing form, with every required price field filled in euros excluding VAT; conditional bids are not permitted. For a joint bid, the bidders must appoint an authorised representative and provide the relevant authorisation.
