Compliance requirements
The bidder must declare whether it or its representatives have relevant convictions, including for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking, and certain tax offences. Exclusion may also apply where taxes or social security contributions are unpaid, the bidder is bankrupt, insolvent, being liquidated, or its business activities are suspended, or where it has committed serious professional misconduct, colluded to distort competition, has an unmanageable conflict of interest, or improperly participated in preparing the procurement.
Other grounds include serious or repeated failures under previous public contracts resulting in early termination, damages or comparable sanctions; providing false or misleading information, withholding required information or documents, or seeking confidential information to gain an improper advantage; enabling the unlawful employment of a foreign national; and being subject to applicable international sanctions. Where permitted, the bidder may provide evidence of measures taken to restore its reliability. The bidder must also confirm that it will not use a subcontractor who would have to be replaced under the applicable procurement rules.
Qualification criteria and exclusion grounds
The bidder must be registered in the relevant business register. Its general annual turnover in either the 2024 or 2025 financial year must be at least EUR 30,000 for each lot for which it seeks qualification. The contracting authority will verify this in the business register; if the information is not available there, the bidder must provide supporting evidence.
The bidder must have at its disposal at least two four-wheel-drive snow-clearing tractors, or similar machines, each with at least 100 hp and a snowplough of at least 2.5 m that can be adapted to different road conditions using a steel or rubber blade. It must also have at least one machine suitable for clearing cycle paths and pavements, with a maximum weight of 3.5 tonnes and a pivoting snowplough adaptable to different road conditions using a steel or rubber blade. All machines must have a bidder-installed GPS tracking device accessible to the contracting authority and a yellow warning beacon.
The bid must include a list of the machines and their required technical specifications, together with a copy of each machine’s registration certificate or another document showing its owner and technical details. If a machine is not owned by the bidder, evidence of the bidder’s right to use it must also be provided. The bidder must submit its price using the structure specified in the tender documents and confirm that its bid complies with all tender conditions; conditional bids are not permitted.
