Compliance requirements
The bidder must confirm that no exclusion grounds apply to it or to members of its management, administrative or supervisory bodies, or its representatives. The grounds include convictions within the past five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences linked to terrorist activities, money laundering or terrorist financing, and illegal use of child labour or human trafficking. They also cover failure to pay taxes or social security contributions; breaches of environmental, social or labour law obligations; bankruptcy, insolvency, liquidation or a similar situation; suspension of business; serious professional misconduct; agreements distorting competition; an unavoidable conflict of interest; or an unjustified advantage resulting from involvement in preparing the procurement. Other grounds include material or repeated breach of a previous public contract, submission of false information or failure to provide required information or documents, improper acquisition of confidential information, enabling the employment of a foreign national staying in the country without a legal basis, breaches of international or national sanctions, and convictions for tax offences.
The stated threshold for tax debt is EUR 0, but under Estonian tax administration rules a tax-debt certificate is not issued where the debt is below EUR 100 or payment has been rescheduled. For bidders from another country, the rules of their country of establishment apply. For certain exclusion grounds, the bidder may submit evidence of measures taken to restore its reliability if this option is permitted for the procurement.
