Compliance requirements
The bidder must declare whether it, or relevant persons who represent, manage or control it, are subject to exclusion grounds. These include final convictions within the relevant period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also cover unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation or comparable proceedings; environmental, social or labour-law violations; serious professional misconduct; competition-distorting agreements; conflicts of interest that cannot otherwise be remedied; improper involvement in preparing the procurement; and significant or repeated failure to perform earlier contracts, including early termination, damages or penalties.
Further grounds include false or misleading information, failure to provide required information or documents, attempts to influence the procurement improperly or obtain confidential information, enabling unlawful employment of a foreign national, being subject to an international sanction, and convictions for tax offences. Where legally available, the bidder may provide evidence of remedial measures demonstrating restored reliability. The tender documents also require declarations concerning authorised representatives and sanctions.
Qualification criteria and exclusion grounds
The bidder’s net turnover in its most recently completed financial year must be at least EUR 100,000. Joint bidders may combine their turnover. The buyer may request the annual report extract or other evidence of turnover; for an Estonian company, this is not required if the information is publicly available to the buyer. If relying on another entity’s turnover, provide that entity’s tender passport and, when requested, its consent confirming the amount made available, the provision of financial resources if needed, and joint and several liability for the relevant part of the contract.
Within the 60 months before the procurement began, the bidder must have properly completed at least one contract for construction works on a public road that included laying at least 2,000 m² of asphalt-concrete wearing course. Provide the contract details in the tender passport. If requested, submit the client’s confirmation stating the completion period, the area of wearing course laid and that the work was properly performed. If relying on another entity’s technical capacity, provide its tender passport and, when requested, its consent confirming the capacity relied upon and its participation in performing the relevant contract work.
The bidder must confirm acceptance of all tender conditions and submit an offer only for the matters for which competing offers were requested. Complete every price entry in the prescribed cost schedule; do not alter or remove any listed item, description, parameter, unit, quantity or other buyer-provided data. Submit the completed schedule as an Excel file, with totals in euros to two decimal places. Identify any trade secrets and explain the designation, or state that the offer contains none; prices and other specified evaluation figures may not be designated as trade secrets.
For a joint bid, submit the required signed authorisation and a separate tender passport for each member. Provide the names and personal identification codes of authorised representatives not visible in the relevant company-register extract, or confirm that there are no such representatives. If relying on other entities, submit the required tender passports and supporting consents when requested.
