Implementation of personnel and payroll software and provision of software maintenance and support services

The bidder must declare that neither the company nor its authorised representatives or management members are subject to exclusion grounds, including convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The bidder must also confirm that it has no outstanding tax or social security payment obligations, and is not in breach of applicable environmental, social or labour-law obligations. Further grounds cover bankruptcy, insolvency or liquidation proceedings, similar financial situations, assets managed by a liquidator or court, suspended business activity, serious professional misconduct, agreements intended to distort competition, conflicts of interest, involvement in preparing the procurement, serious failures under previous public contracts, and the submission of false or missing information or documents. National exclusion grounds also concern enabling the employment of unlawfully staying foreign nationals, international sanctions, local tax debt owed in the contracting authority’s location and convictions for tax offences. Where applicable, the bidder may describe measures taken to restore its reliability. First-tier subcontractors will also be checked against the applicable exclusion grounds and must submit a European Single Procurement Document.

The bidder must have completed at least two contracts during the 36 months preceding the start of the procurement for the development and/or implementation of personnel and payroll software for an organisation with at least 100 employees. The bid must include information about each reference contract, including the contract date, the contracting party’s name and the contracting party’s contact details or the relevant public procurement register reference. The bidder must also hold an ISO 27001 information security management certificate or an equivalent quality management system. The bidder must submit a compliant bid and all required evidence in accordance with the tender documents. If submitting a joint bid, the bidders must appoint an authorised representative and include the relevant power of attorney. The bidder must disclose any business secrets with reasons, must not use a subcontractor that would have to be replaced under the applicable procurement rules, and must submit the bid price in the prescribed structure. Second-tier subcontracting is not permitted.
