The bidder must confirm that the company, its management or supervisory board members, representatives and controlling persons have not been convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. There must also be no breaches of environmental, social or labour law, bankruptcy, liquidation, insolvency proceedings, an arrangement with creditors, assets under the control of a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, unavoidable conflicts of interest or improper involvement in preparing the procurement. Grounds for exclusion may also include a serious or repeated breach of a previous public contract, false statements, failure to provide required information or documents, or improper influence on the contracting authority’s decision-making. The bidder must have fulfilled its tax and social security payment obligations; the notice states a tax debt threshold of EUR 0, while the tax authority does not issue a certificate for debt below EUR 100 or for rescheduled debt. The confirmations also cover compliance with international sanctions and offences involving the employment of unlawfully staying foreign nationals or tax offences. Where an exclusion ground exists, the contracting authority may, where provided for, request explanations and evidence of remedial measures. First-tier subcontractors are subject to the same control principles, and a subcontractor passport must be submitted where the bidder relies on that subcontractor’s qualifications.

The person responsible for the bidder’s construction works must hold at least B-level electrical competence, a level 7 electrical engineer qualification, or an equivalent qualification. The bidder must provide this person’s name, qualification and professional certificate number in the European Single Procurement Document. For a qualification issued outside Estonia, the bidder must provide a copy of the qualification document and confirmation from the competent Estonian authority that it meets the required qualification. The responsible specialist must have at least 5 years of experience designing, constructing or reconstructing low-voltage main switchboards, backup power systems, RLA systems or electrical installations of comparable technical complexity, and experience on at least one site involving installation or reconstruction of a main switchboard, design or reconstruction of an RLA system, integration of backup diesel generator automation with a main switchboard control system, or reconstruction of electrical installations in an operating hospital, industrial undertaking or another site with systems that cannot tolerate interruption. The bidder must submit the CV in the format of Annex 4. Within the 60 months preceding the start of the procurement, the bidder must have completed at least 3 contracts as the main contractor for construction works of similar technical complexity to the subject matter of the procurement. At least one contract must have included one of the works listed above. References must be submitted using Form 1, with evidence of proper performance provided upon request. The bidder must hold a valid registration in the Estonian Register of Economic Activities authorising electrical works. The tender must include the required contact details, the price form in Annex 2 and the responsible specialist’s CV. The tender must comply with all procurement documents and conditional tenders are not permitted. A confirmation of having inspected the contract performance site must be submitted. If subcontracting is used, the bidder must provide subcontractor details and the subcontracted share as a percentage; when relying on another entity’s resources, the bidder must include that entity’s written consent and the relevant procurement passport. Joint bidders must submit a power of attorney. The bidder may not use a subcontractor subject to mandatory replacement or subcontractors or suppliers covered by Russian sanctions for more than 10% of the contract value.
