Compliance requirements

A bidder will be excluded if the bidder, or a member of its management or supervisory body, a procurator, or another person authorised to represent or control it, has been convicted of participation in a criminal organisation, breach of the duty of integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Exclusion also applies to convictions for enabling the employment of a foreign national staying in the country unlawfully or breaching the conditions for employing a foreign national in Estonia, including paying less than the required wage, as well as for unlawful use of child labour or an offence related to human trafficking. The bidder must not have outstanding national tax, payment or environmental charge debts, or tax or social security contribution debts under the laws of its country of establishment. The contracting authority may also exclude a bidder for a substantial or repeated breach of an earlier public contract where this resulted, for example, in withdrawal from or termination of the contract, a price reduction, compensation for damage or a contractual penalty. Providing false information about compliance with the qualification requirements, or failing to submit required information or documents, may also constitute grounds for exclusion. An undertaking established or resident in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components originating from Russia or Belarus may not be used or installed during the works; the contracting authority may request certificates of origin for verification. The bidder must confirm these matters in the tender.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the tender. At least one contract must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting parties, the contracting authority representative’s telephone number and email address, and, for public contracts, the relevant reference numbers. The contracting authority may request evidence of proper performance. The bidder must have an employee with switching rights for work-related switching operations in a 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before tenders are opened. For low-voltage works only, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required. The bidder must also have a person designated as responsible for the work operation, registered in the same portal before tenders are opened. The person managing the electrical works must hold valid A-level competence or a qualification of at least level 6 under the Occupational Qualifications Act, possess the relevant certificate, and be registered in Elektrilevi’s partner portal before tenders are opened. The tender must comply with all procurement documents; conditional tenders and tenders containing additional conditions are not permitted. The tender price must be submitted in the required table, with all unit-price fields completed. The bidder must provide the contract signatory’s details, the basis for signing authority, and the contract performance contact person’s details; a power of attorney must be added where necessary. The bidder must identify any trade secret and justify its classification, or confirm that the tender contains no trade secrets.
