Compliance requirements

The bidder and its representatives, management or supervisory board members must not have been finally convicted within the previous five years, where the exclusion obligation still applies, of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the unlawful use of child labour or other forms of human trafficking. The bidder must not have outstanding tax or social security payment obligations. Exclusion may also result from a serious or repeated breach of a previous public contract that led to early termination, compensation or another comparable sanction. In addition, the bidder must not have enabled an unlawfully staying foreign national to work, be subject to international sanctions, or belong to a category of undertakings restricted in the procurement documents. The bidder must provide the required declarations and, where necessary, information and evidence; where an exclusion ground exists, evidence of remedial measures may be submitted if permitted by the tender documents.

Qualification criteria and exclusion grounds

The bidder must be registered in the Estonian Register of Economic Activities for the field “fire safety design, construction and maintenance”. Reliance on another entity’s capacity is not permitted for this registration, which must be evidenced where required. During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least one contract for the installation or renewal of an automatic fire alarm system. At the contracting authority’s request, the bidder must submit a client confirmation stating the period of performance, the installation or renewal works carried out and their proper completion. If the bidder relies on another entity’s capacity, it must submit that entity’s European Single Procurement Document and the required consent; the other entity must participate in contract performance at least to the extent for which its capacity was relied upon. The tender must include a fully completed price schedule in Excel format. The bidder may not amend or delete the payment items, names, work descriptions, parameters, units or quantities specified by the contracting authority. The bidder must confirm that the tender includes all costs related to materials, equipment and performance of the works and that it accepts the conditions in the contract notice and tender documents. In the case of a joint tender, separate procurement documents for all joint bidders and a power of attorney must be submitted. The bidder must also provide the names and personal identification codes of authorised persons not visible to the contracting authority, or confirm that no such persons exist.
