Infrastructure construction works for Phase I of the Aluvere business and industrial area

The bidder must confirm that the bidder, its management or supervisory board members, procurists and other persons authorised to represent or control it have not been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the illegal use of child labour or human trafficking. Where relevant, the bidder must provide details of the conviction and describe measures taken to restore its reliability. Exclusion may also apply in cases involving breaches of tax or social security payment obligations, environmental, social or labour-law obligations, bankruptcy or other insolvency proceedings, an agreement with creditors, assets being administered by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, material breaches of previous contracts, or false information and failure to provide required documents. The bidder must also confirm that awarding the contract would not breach an international or Estonian sanction and that it has not enabled an unlawfully staying foreign national to work or breached the conditions for employing foreign nationals in Estonia. The stated threshold for tax or social security arrears is EUR 0; however, a tax debt certificate is not issued in certain cases, including where the debt is below EUR 100 or payment has been deferred. The bidder must confirm that it will not use a subcontractor during contract performance who would have to be replaced under section 122(7) of the Estonian Public Procurement Act. First-tier subcontractors will be checked during contract performance; they are not required to submit a European Single Procurement Document. All precise verification and evidence requirements must be checked in the tender documents before submitting the tender.

The bidder must be registered in the relevant commercial or professional register or provide a valid registration certificate. For Lot I, the bidder must hold a registration in the Estonian Register of Economic Activities for construction activities in the public water supply or sewerage field. For Lot II, the bidder must hold a registration for construction activities in the road field. A bidder established outside Estonia must provide a certificate from the competent authority in its country of establishment confirming the required registrations or permits, issued within 30 days before the tender submission deadline or later. For both lots, the bidder's average annual turnover for the last three financial years completed before the start of the procurement procedure (01.01.2023–31.12.2025) must be at least EUR 500,000. If requested, the bidder must provide an extract from the annual accounts for the three latest completed financial years. The technical experience requirement concerns works completed during the last 60 months. For Lot I, the bidder must have completed at least two contracts for the construction or reconstruction of public water supply and sewerage pipelines, each involving at least 1,500 metres of pipelines. For Lot II, the bidder must have completed at least one contract for the construction or reconstruction of a street involving at least 1,500 metres of street construction. The works must have been accepted by the client. The bidder must provide a list of the works and the required information on the client, contact person, contract value, period and the bidder's scope of responsibility. For Lot I, the team must include separate construction project and site managers for public water supply and sewerage facilities. Each must hold either a level 7 diploma-level water supply and sewerage engineering qualification or a level 6 construction manager qualification with the required specialisation, or an equivalent qualification from the country of establishment. The Lot I key personnel may not be combined. For Lot II, the team must include a construction project manager for road construction with a level 7 diploma-level road engineering qualification or an equivalent qualification from the country of establishment. Higher-level qualifications are also permitted. Team details must be submitted using the prescribed form. For foreign qualifications, a copy of the certificate or other evidence of the right to perform the relevant work must be provided. The bidder must submit a tender meeting the compliance requirements, Form 1 and the bill of quantities for the relevant lot. For a joint tender, Form 2 must be submitted; where the bidder relies on another entity's resources, Form 6 is required; where a key person is not employed under an employment contract by the bidder, the key person's employer confirmation in Form 3 is required. If subcontractors directly participating in contract performance are used, Form 5 must be submitted with the description of their works, the percentage of the estimated contract price and the subcontractor's name, registration code and legal address. A person without signing authority must provide a power of attorney to sign the tender.
