Compliance requirements
The bidder must declare whether it or its representatives have relevant convictions within the previous five years, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Grounds also cover breaches of tax or social security payment obligations; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business; serious professional misconduct; anti-competitive agreements; conflicts of interest; involvement in preparing this procurement where an advantage cannot otherwise be avoided; significant failures under previous contracts resulting in early termination, damages or comparable sanctions; and false or misleading information, failure to provide required information or documents, or improper attempts to obtain confidential information or influence decisions.
National grounds include enabling a person without lawful residence to work, entering into a contract in breach of international or national sanctions, and certain tax offences. The bidder must provide the required declarations and relevant details, and may be asked to provide supporting evidence. Where the applicable rules allow it, the bidder may explain remedial measures taken to restore its reliability. The notice notes that a tax-debt certificate may not be issued for debt below EUR 100 or where payment has been deferred.
Qualification criteria and exclusion grounds
The bidder must demonstrate that, during the 60 months preceding publication of the contract notice, it has properly completed at least three similar construction contracts. For each contract, the bidder must have acted as the main contractor; the works must have concerned a building, part of a building or a building complex with at least 400 m² of enclosed net floor area, and must have involved construction, extension or reconstruction. Provide a list of the projects with the client’s name and contact details, a description showing how the experience meets the requirement, the floor area and the contract period. Include the procurement reference number where a contract resulted from a public procurement. At the contracting authority’s request, provide client confirmation that the works were properly completed and meet the stated requirements.
The construction team must include a project manager who is a certified construction engineer at level 7 and a site manager who is a construction engineer at level 6. One person may perform both roles only if they hold the level 7 qualification required for the project manager. Provide the personnel details and evidence or references allowing their qualifications to be checked. Foreign qualifications must be at least equivalent; provide an Estonian translation and evidence of equivalence where required.
The bidder must also involve the following qualified designers and specialist personnel in contract performance: authorised interior architect, level 7; certified construction engineer, level 7; certified automation engineer, level 7; certified electrical engineer, level 7, with at least a class B competence certificate for electrical design; security systems designer, level 6; and fire safety expert, level 6. The required professional level must be higher if the applicable professional standard so requires. The contracting authority may request signed commitments from the successful bidder’s personnel.
The bidder must conduct a mandatory site visit before submitting its tender and include the site-visit certificate. It must submit the price offer using the prescribed structure and the pricing table in Annex 3. Conditional tenders are not permitted. The bidder must accept the tender-document deadlines and give irrevocable consent to set off penalties against the contract price if delay is attributable to the contractor. A minimum 24-month warranty is required from signing of the final handover and acceptance certificate; the bidder must state the warranty repair response/completion period in days, which is not specified in the available text.
