Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that neither it nor its representatives or members of its management or supervisory bodies have, within the past five years or under a continuing exclusion decision, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal use of child labour or human trafficking. Grounds for exclusion may include failure to pay taxes or social security contributions; breaches of environmental, social or labour law; bankruptcy or other insolvency proceedings; an arrangement with creditors; liquidation; assets being administered by a liquidator or court; suspension of business activities; serious professional misconduct; anti-competitive agreements; an unresolved conflict of interest; or involvement in preparing the procurement in a way that gives an unavoidable advantage. Further grounds may include serious or repeated breach of a previous public contract, submission of false information, failure to provide required information or documents, or improperly obtaining confidential information or influencing decisions. The bidder must also confirm that entering into a contract with it would not breach international or Estonian sanctions and that it has not enabled a foreign national staying in Estonia without lawful grounds to work or breached the conditions governing that person’s employment. The procurement documents may also provide for exclusion due to local tax debt in the contracting authority’s area, a tax offence, or lack of the right to bid because of the bidder’s place of residence or establishment. For tax debt, the tax authority does not issue a debt certificate where the debt is under EUR 100 or payment has been deferred. If an exclusion ground applies, the bidder may submit evidence of measures taken to restore its reliability where permitted by law or provided for in the procurement documents.

Qualification criteria and exclusion grounds

The qualifications of the training provider(s) must meet the minimum requirements in section 3 of the technical specification; bids that do not meet them will not be evaluated. The bidder must provide: - CVs for the trainer(s), covering relevant training delivered during the five years preceding the bid deadline. For each training, the CV must state at least its title, client, delivery date, duration in academic hours, target group and the trainer’s role; - a training programme describing the topics and learning materials; - descriptions of the learning outcomes, teaching methodology and assessment of whether the learning outcomes have been achieved. The bidder must confirm that its bid complies with the procurement documents and, where an equivalent solution is offered, explain the equivalence and provide supporting evidence. The comparison between the offered and required solution must demonstrate compliance, including the model name and, where appropriate, photographs or drawings. The price must follow the required structure, be stated in euros to two decimal places, include all costs associated with providing the service, and be neither zero nor negative nor exceed the estimated contract value. Conditional bids are not permitted. For a joint bid, the participants must appoint an authorised representative and include a power of attorney; joint bidders are jointly and severally liable for contract performance. The bidder must identify and justify any information claimed as a trade secret; the bid price and numerical figures relating to the evaluation criteria for services may not be classified as trade secrets. The bidder must confirm that neither it nor persons acting on its behalf have engaged in corrupt conduct in the procurement. It must also ensure that personnel directly delivering the service have not committed offences against minors or offences against the person. The supplied documents do not specify an evaluation scoring scheme; check the evaluation conditions in the procurement documents.
