Compliance requirements
A bidder must be excluded if it or a person authorised to represent, manage or control it has been convicted of offences involving participation in a criminal organisation, breach of trust, corruption, fraud, terrorism or related offences, money laundering or terrorist financing, unlawful employment of foreign nationals or breaches of their employment conditions, or illegal child labour or human trafficking. Exclusion also applies where the bidder has outstanding national taxes, levies or environmental charges, or tax or social security debts under the laws of its country of establishment.
The contracting authority may exclude a bidder for serious or repeated breaches of material terms of previous public contracts that led to termination, withdrawal, a price reduction, compensation or a contractual penalty. It may also exclude a bidder for providing false information about compliance with qualification requirements or failing to provide that information or requested supporting documents. Companies established in Russia or Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement; at least one contract must be worth €100,000 or more, excluding VAT. The bidder must provide a list stating the performance period, the other contracting parties and their representatives’ contact details, including telephone and email, and procurement reference numbers where applicable. Evidence of proper performance must be supplied on request unless the contracting authority can obtain it from databases without significant cost. The specified form for previous electrical works contracts must be completed; written confirmations from the other contracting parties must also be provided where necessary.
The bidder must have a worker with valid switching rights for switching operations on the 0.22–20 kV electricity network related to the works, including operational switching, isolation and earthing, re-energisation and restoration of the normal configuration, except at regional and distribution substations. The worker must be registered in Elektrilevi’s Partner Portal before bids are opened. For works limited to low voltage (0.22–1 kV), low-voltage switching rights are sufficient; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV).
The bidder must have a person designated as responsible for the work operation, registered in the Partner Portal before bids are opened. It must also have a person leading electrical works who holds valid A-class competence and/or a qualification of at least level 6 under the Qualifications Act, has the relevant evidence by the bid submission deadline, and is registered in the Partner Portal before bids are opened.
The bid must comply with the procurement documents; conditional bids and bids with additional conditions are not permitted. The price must be submitted using the prescribed table, with every unit-price field completed. The bidder must provide the contract signatory’s name, position and contact details, identify a contact person for contract-related matters, and provide a power of attorney if the signatory’s authority does not arise from the articles of association. Any information claimed as a trade secret must be identified and justified; prices and figures relevant to bid evaluation may not be treated as trade secrets.
The standard payment period, calculated from receipt of the invoice, is 14 calendar days for contracts up to €59,999, 35 days for contracts from €60,000 to €249,999, and 45 days for contracts of €250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. No award criterion or scoring method is specified in the provided documents.
