Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation; breach of professional integrity or a corrupt act; fraud; a terrorist offence or related conduct; money laundering or terrorist financing; enabling the unlawful employment of a foreign national or breaches of the conditions for their employment in Estonia, including paying less than the statutory wage; or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding state tax, levy or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a material term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation for loss or a contractual penalty. It may exclude a bidder that has provided false information about meeting qualification requirements or failed to provide that information or requested supporting documents. An undertaking established in Russia or Belarus is not permitted to participate.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must be worth EUR 40,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details, including a client representative’s telephone number and email address, and the procurement reference number for public contracts. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost. The bidder must have, and register in Elektrilevi’s partner portal (EPP) before tenders are opened: - a person with valid switching rights for the relevant 0.22–20 kV network switching operations, except in area and distribution substations. For low-voltage-only works (0.22–1 kV), low-voltage switching rights are required; otherwise both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side; - a person appointed as responsible for the work operation; and - a person leading the electrical works who holds valid A-level competence and/or a qualification of at least level 6 under the Professions Act, with the corresponding evidence valid when tenders are submitted. The tender must comply with the procurement documents without additional or conditional terms. The bidder must submit the price using the prescribed table and complete every unit-price field. The bidder must identify the contract signatory or signatories, provide their names, job titles and contact details, and designate a contact person for contract matters. If signing authority does not arise from the articles of association, a power of attorney must be included. The standard payment period, calculated from the contracting authority’s receipt of the invoice, is 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The bidder must identify any trade secrets in its tender and explain that designation; prices and information used for evaluating tenders may not be designated as trade secrets. No award criterion is specified in the provided documents. Materials, equipment and goods, including components, installed or used during the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin.
