Compliance requirements
A bidder will be excluded if it is bankrupt or being wound up, subject to bankruptcy or liquidation proceedings, has suspended its business, or is in an equivalent situation under the law of its country of establishment. Exclusion also applies where the bidder has outstanding national taxes, duties, environmental charges, or tax or social security contributions. Such debt may be paid or rescheduled within 10 calendar days after notice of the ground for exclusion.
The bidder and, in a joint tender, each joint bidder must not be subject to the exclusion grounds under § 95(1), points 1–3 and 5, of the Estonian Public Procurement Act, taking account of § 95(2). In addition, the average wages of the bidder’s employees during the reference period must not be below 70% of the sector average for the same period. This requirement does not apply if the bidder has no employees. The reference period is six calendar months ending in the second calendar month before the month in which the procurement began; for a recently established bidder, it starts in the month of establishment or commencement of business. Foreign bidders must provide equivalent evidence from the competent authority in their country.
The bidder must not be a related person to the technical consultant advising the beneficiary on the apartment building’s reconstruction. Where a joint tender is submitted, the relevant exclusion grounds apply if they exist for any joint bidder. The buyer will check information through public registers where possible. If it cannot verify the absence of a ground and the bidder has not already provided evidence, the bidder must supply the requested documents and information within 10 calendar days or may be excluded.
Qualification criteria and exclusion grounds
The bidder must be registered for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems. Where electrical works are performed, the required registration must also cover construction and installation of electrical installations. Foreign bidders may provide evidence of equivalent qualifications instead of Estonian register entries.
The bidder’s net turnover in the financial year preceding submission of the tender must be at least twice the estimated contract value, calculated exclusive of VAT. The bidder must confirm that it can provide, by the date the construction contract is signed, an on-demand guarantee issued by a credit or financial institution or insurer for 5% of the construction contract value exclusive of VAT. If the contract is signed before the guarantee is provided, it must be submitted within 10 calendar days after signing. The guarantee must remain valid throughout the construction period. A deposit to the beneficiary’s bank account or a notary’s account is also acceptable, provided the beneficiary retains the right to the funds throughout the construction period. Joint bidders may provide the guarantee jointly.
During the 60 months before commencement of the procurement, the bidder must have completed at least one comparable construction project worth at least half the estimated contract value. It must have acted as the main contractor on the construction, extension or full-building reconstruction of a building, including construction or reconstruction of the load-bearing structures and external envelope, heat-recovery mechanical ventilation, and a new heating system. Provide details of the project, its completion period and value, and evidence by reference to the building register use notice or use permit number, or a copy of the handover and acceptance certificate signed by the client and contractor.
The team must include: a project manager with at least a level 6 construction engineer qualification specialising in building construction and the relevant construction-management competence, or an equivalent level 6 construction manager qualification; a site manager with at least a level 5 construction work manager qualification in general construction; a heating and ventilation specialist with at least a level 6 heating, ventilation and cooling engineer qualification and the relevant construction-management competences, or an equivalent level 6 construction manager qualification in indoor climate systems; a water supply and sewerage specialist with at least a level 6 water supply and sewerage engineer qualification and construction-management competence, or an equivalent level 6 construction manager qualification in building water supply and sewerage; and, for electrical works, a specialist with at least a class B competence certificate or a level 6 electrical engineer qualification for consumer electrical installations. Provide each specialist’s name and qualification certificate number. Equivalent qualifications are accepted for foreign bidders. A level 7 authorised architect, or a person with equivalent foreign qualifications, must also be responsible for ensuring that the building project complies with the New European Bauhaus requirements. Where relying on another person’s qualifications, provide that person’s signed commitment to participate in contract performance.
The bidder must have an implemented construction-sector quality management system meeting at least EVS-EN ISO 9001 or an equivalent standard, and an environmental management system meeting at least EVS-EN ISO 14001 or an equivalent standard. Submit evidence of both systems.
The tender price must follow the structure specified in the pricing worksheet. The completed tender form must also be submitted, and the sum of its item prices and unit prices must match the amount entered in the pricing worksheet. Joint bidders must submit an authorisation appointing their representative. The tender must accept the procurement-document conditions and must not be conditional. Any information identified as a trade secret must be justified; the total price, item prices and evaluation-related figures or indicators may not be classified as trade secrets. The provided documents do not specify the award criteria; check the official procurement documents for them.
