Compliance requirements
The tenderer may be excluded if it, or a person authorised to represent, manage or control it, has a relevant conviction within the past five years or remains subject to an exclusion period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion may also apply for failure to pay taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, comparable circumstances, administration of assets by a liquidator or court, or suspension of business; serious professional misconduct; agreements intended to distort competition; an unresolved conflict of interest; involvement in preparing this procurement that creates an unavoidable competitive advantage; serious or repeated breach of an earlier public contract resulting in early termination, damages, a price reduction or a penalty; or false or misleading information, failure to provide required information or documents, or improper attempts to influence the procurement or obtain confidential information. Domestic grounds also include enabling an illegally present foreign national to work or violating the conditions for employing a foreign national, and being subject to international sanctions. A tax debt below EUR 100 or a rescheduled tax debt is subject to the stated Estonian tax-authority evidence rules. The same exclusion grounds are checked for first-tier subcontractors during contract performance. Companies established in Russia or Belarus, and entities whose qualifications the tenderer relies on that are established there, may not participate.
Qualification criteria and exclusion grounds
The tenderer’s net turnover must have been at least EUR 400,000 in each of the last two financial years completed before the procurement began. If the financial year coincides with the calendar year, the relevant years are 2024 and 2025; report the turnover for both years in the procurement passport.
The tenderer must have properly completed at least one similar construction contract during the 60 months before the contract notice was published in Estonia’s Public Procurement Register. The tenderer must have acted as the main contractor. The works must have involved constructing or reconstructing a low-voltage switchboard with a rated current of at least 630 A at a substation, switchgear facility, technical room or other building or part of a building containing electrical installations. They must also have included construction or reconstruction of a substation building and low-voltage switchboard, including installation or reconstruction of electrical installations (such as switchgear, circuit breakers, cables and earthing systems), and installation, connection and commissioning of power transformers, substation switchgear and high-current main low-voltage distribution boards (MDBs). Provide a list of contracts with the contracting parties’ names and contact details, the project subject, enclosed net floor area, contract period and, if applicable, procurement reference number. The contracting authority may request a client confirmation that the works were properly performed. Where relying on another entity’s experience, that entity must personally perform the relevant contract or part of it, and its procurement passport must be provided.
The tender must accept all conditions in the procurement documents. Submit Form 2, including subcontractor details and, where applicable, a reasoned list of documents designated as trade secrets. Submit the price in euros, excluding VAT, both in the procurement register and using the completed Form 3 price table; if the totals differ, the total calculated from Form 3 applies. Submit Form 4 CVs for the construction specialists required by Form 4.1. If professional qualifications or equivalent evidence were issued outside Estonia, include those documents with the tender. Obtain the access-restricted technical documents from the contracting authority and confirm that the restricted information will be protected. For a joint tender, appoint an authorised representative and provide the power of attorney and confirmation of joint and several liability using Form 8. No detailed award-scoring criteria are stated in the supplied documents.
