Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder will be excluded if the bidder or a relevant representative, manager, supervisory-board member or other person authorised to represent or control it has been convicted of participation in a criminal organisation, breach of professional integrity, corruption, fraud, terrorist offences or related participation, money laundering or terrorist financing; offences concerning the unlawful employment of foreign nationals or breaches of their employment conditions, including underpayment; or unlawful use of child labour or human trafficking. A bidder will also be excluded for outstanding state tax, other public-law payment or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. The contracting authority may exclude a bidder for serious or persistent breaches of material terms of a previous public contract resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty. It may also exclude a bidder that provided false information about meeting qualification requirements or failed to provide that information or requested supporting documents. Companies established in the Russian Federation or the Republic of Belarus may not participate in the procurement.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the procurement during the 60 months preceding the start of the procurement; at least one contract must have a value of at least EUR 40,000 excluding VAT. The bidder must provide a list stating the performance period, the other contracting parties’ details, including the client representative’s telephone number and email address, and, for public contracts, the reference numbers. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost. The bidder must have a worker authorised to carry out switching operations connected with the works in the 0.22–20 kV electricity network, excluding regional and distribution substations. The worker must be registered in Elektrilevi’s partner portal before bids are opened. For works limited to 0.22–1 kV, low-voltage switching rights are sufficient; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side. The required training and authorisations must follow the applicable Elektrilevi instructions. The bidder must also have a person appointed as responsible for the work operation, registered in the partner portal before bids are opened, and a person leading electrical works who holds a valid A-level electrical competence and/or a qualification of at least level 6 under the Professions Act. The latter must hold evidence of the qualification when bids are submitted and be registered in the partner portal before bids are opened. The bid must accept all tender-document conditions; conditional bids or bids containing additional conditions are not permitted. The price must be submitted using the prescribed table, with every unit-price field completed, and the bid must take account of the instructions for completing management-system document V178. The bidder must provide the contract signatory’s name, position and contact details, identify a contact person for contract matters, and provide a power of attorney if the signatory’s authority does not arise from the articles of association. Standard payment periods, counted from the client’s receipt of an invoice, are 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The bidder must identify any trade secrets in its bid and explain their designation; the bid price and other specified evaluation-related figures may not be classified as trade secrets.
