Compliance requirements
The bidder will be excluded if the bidder or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the unlawful employment of foreign nationals or breaches of the conditions for their employment, including underpayment; or illegal child labour or human trafficking. Exclusion also applies where the bidder has outstanding national taxes, duties or environmental charges, or tax or social-security contribution arrears under the law of its country of establishment.
The contracting authority may exclude a bidder for serious or repeated breaches of material terms in previous public contracts where this led to termination, withdrawal, a price reduction, compensation or a contractual penalty. It may also exclude a bidder for providing false information about compliance with qualification requirements or failing to provide that information or requested supporting documents. Companies established in the Russian Federation or Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement; at least one contract must be worth €40,000 or more excluding VAT. Submit a list stating each contract’s performance period, the other contracting party and its representative’s contact details, including telephone number and email address, and the procurement reference number where applicable. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from databases without significant cost.
The bidder must have a worker with valid switching authorisations for the relevant work in the 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before bids are opened. For works limited to low voltage (0.22–1 kV), low-voltage switching authorisations are required; otherwise both low- and medium-voltage authorisations are required, including where low-voltage work requires switching on the medium-voltage side. Applications must follow instruction J387. The bidder must also have a person appointed to be responsible for the work operation, registered in the partner portal before bids are opened; the relevant rights must be obtained in accordance with documents J31 and J3284.
The bidder must have a person directing electrical works who, by the bid submission deadline, holds valid A-level competence and/or a qualification of at least level 6 under the Qualifications Act, has the corresponding evidence, and is registered in the partner portal before bids are opened.
The bid must accept all procurement-document conditions without additions or qualifications. Submit the price using the prescribed table and complete every unit-price field, taking account of instruction V178. Identify any information claimed as a trade secret and give reasons; the bid price, price components and other evaluation-related numerical indicators may not be designated as trade secrets.
Provide the name, title and contact details of the contract signatory or signatories and a contract-performance contact. If signing authority does not arise from the articles of association, include a power of attorney. The bidder must choose the applicable payment arrangement: standard payment periods are 14 calendar days for contracts up to €59,999, 35 days for contracts from €60,000 to €249,999, and 45 days for contracts of €250,000 or more, counted from receipt of the invoice. Participation in the contracting authority’s factoring programme applies a 95-calendar-day payment period.
The bidder must confirm that the materials, equipment and goods, including components, used in the works are not produced in or originating from the Russian Federation or Belarus; the contracting authority may request certificates of origin. Price is not stated as the sole award criterion in the supplied documents.
