Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if the bidder, or a member of its administrative, management or supervisory body, an authorised representative, or another person empowered to represent, decide for or control the bidder, has been convicted of participation in a criminal organisation, breach of integrity duties or a corrupt act, fraud, terrorism-related offences, money laundering or terrorist financing; of enabling an illegally present foreign national to work or enabling a breach of the conditions for a foreign national’s employment in Estonia, including payment below the statutory wage rate; or of unlawful use of child labour or human trafficking. A bidder with outstanding state tax, levy or environmental-charge debts, or tax or social-security contribution debts under the law of its country of establishment, will also be excluded. The contracting authority may exclude a bidder that has substantially or persistently breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty. It may also exclude a bidder that provided false information about meeting qualification requirements or failed to provide that information or requested supporting documents.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have a value of €40,000 or more, excluding VAT. The bidder must provide a list showing each contract’s performance period and the other contracting party’s details, including a contact person’s telephone number and email address; for public contracts, include the reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost. The bidder must have an electrical works manager with a valid A competency certificate and/or a qualification of at least level 6, holding the relevant evidence by the bid submission deadline and registered in Elektrilevi’s partner portal before bids are opened. The bidder must also have a person with valid switching rights, registered in that portal before bids are opened. For this low-voltage procurement, at least low-voltage switching rights are required. A person responsible for the work operation must also be appointed and registered in the portal before bids are opened. The bid must include the completed pricing table in the prescribed format, with every unit-price field filled in, and must follow the applicable V178 management-system document instructions. Conditional bids or bids that add conditions are not permitted; submitting a bid confirms acceptance of the procurement documents. The bidder must provide the name, position and contact details of the person(s) authorised to sign the contract, and a contract-performance contact person’s details. If signing authority does not arise from the articles of association, a power of attorney must be included. The standard payment term, counted from receipt of the invoice, is 14 calendar days for contracts up to €59,999, 35 calendar days for contracts from €60,000 to €249,999, and 45 calendar days for contracts of €250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment term. The bidder must identify and justify any information in its bid claimed as a trade secret; the bid price and other specified price or evaluation-related figures may not be classified as trade secrets. The bidder’s registered or residential location must not be in the Russian Federation or Belarus. Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from those countries; the contracting authority may request certificates of origin.
