Compliance requirements

A bidder may be excluded for relevant final convictions of the bidder or its representatives for corruption, fraud, participation in a criminal organisation, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also include breaches of tax or social security payment obligations; environmental, social or labour-law violations; bankruptcy, insolvency, liquidation or comparable circumstances; serious professional misconduct; agreements or conduct that distort competition; an unresolved conflict of interest; involvement in preparing the procurement where an unfair advantage cannot otherwise be prevented; serious or repeated failures under previous public contracts; false or misleading information, withholding required information, failure to provide requested supporting documents, or seeking confidential information to gain an improper advantage. National grounds include enabling the unlawful employment of a foreign national, being subject to an international sanction, tax-related criminal offences, and being ineligible to participate under a restriction based on the bidder’s place of establishment. Corrective measures to demonstrate reliability may be considered where permitted by law. Tax and social security debts below EUR 100, excluding interest not established by an administrative act, are not treated as debts for the stated threshold if payment has been deferred; the applicable rules of the bidder’s country of establishment apply to foreign bidders.

Qualification criteria and exclusion grounds

The bidder’s net turnover over its last three financial years must total at least EUR 600,000. The bidder must provide turnover information in the procurement passport; if the information is not available from a public database, the contracting authority may request the annual accounts for the three most recent financial years or extracts from them. The bidder must list at least one properly completed ventilation construction contract from the 60 months preceding the start of the procurement. The contract must concern a similar building with a ventilated net floor area of at least 2,000 m². A similar building is a public-use building with enhanced indoor-climate requirements whose ventilation system includes air dehumidification and automatic control of indoor-air humidity. The reference must describe the net floor area and performance period and provide details of the other contracting parties, including the client representative’s contact details, telephone number and email address; provide procurement reference numbers for public contracts. Evidence of proper performance must be supplied on request. The team must include: a project manager holding a professional qualification as a certified heating, ventilation and cooling engineer, level 7, or equivalent; a person responsible for electrical work with at least a class B competence certificate or equivalent competence obtained abroad; and a person responsible for fire and security alarm systems holding a level 4 security systems technician qualification for installation and maintenance of fire alarm systems, or equivalent. Provide the names and professional certificate numbers of the responsible specialists. The contracting authority may request evidence of their qualifications. If a specialist is not employed by the bidder or a joint bidder, the bidder must rely on another entity’s capacity and submit that entity’s procurement passport. Joint bidders must appoint an authorised representative and provide the power of attorney. The bid must be unconditional, comply with the procurement documents, and confirm that the bidder has inspected the site. The bidder must identify and justify any trade secrets; the bid price and other figures used to assess the bid may not be marked as trade secrets. The price must follow the stated format, match the total in Appendix 1, and include all work needed for proper completion, including work not expressly described in the procurement documents. A detailed price table using Appendix 1 must be submitted. Where an equivalent solution is offered, explain the equivalence and provide supporting evidence. The bidder must also confirm that it will not use a subcontractor during contract performance who would have to be replaced under the applicable rules, and that the offered goods are not subject to international sanctions and do not originate from sanctioned territories.
