Summary

Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members or representatives have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, illegal child labour or human trafficking offences. Grounds for exclusion may also include outstanding taxes or social security contributions, breaches of environmental, social or labour law obligations, bankruptcy or liquidation, other insolvency, suspension of business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious breaches of previous contracts, or the submission of false information or failure to provide required documents. The bidder must also confirm that the contract would not breach international or Estonian sanctions and that it has not enabled an illegally staying foreign national to work. For tax and social security debts, the stated threshold is EUR 0; the tax authority does not issue a debt certificate where the debt is below EUR 100 or payment has been deferred. Where relevant, the bidder must provide explanations, evidence and a description of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The European Single Procurement Document must include the required confirmations and evidence concerning the bidder, its representatives, any joint bidders, reliance on other entities, subcontractors, and payment of taxes and social security contributions. The machine-readable notice does not specify a particular turnover, previous experience, staffing or professional qualification requirement. Bidders may submit a tender for one or both of the two lots; tenders may be submitted for a maximum of two lots, and contracts may be awarded to one bidder for a maximum of two lots. The tender must be unconditional and comply with all tender documents. The price must be submitted using the structure provided in the award criteria and evaluated indicators worksheet, together with the required price form. A joint tender must include a power of attorney for the joint bidders. The bidder must identify any trade secrets and explain the designation, or confirm that the tender contains no trade secrets; the tender price and other numerical indicators used to evaluate services may not be classified as trade secrets. If the tender differs from a cited standard, label or other technical basis, equivalence must be explained and supported by evidence. The bidder must confirm that it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia, entities more than 50% directly or indirectly owned by them, or representatives or persons acting on their instructions. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
