Compliance requirements
A bidder will be excluded if the bidder or a person authorised to represent, direct or control it has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorist offences, money laundering or terrorist financing, unlawful employment of foreign nationals or related employment violations, or unlawful child labour or human trafficking. A bidder with outstanding national taxes, charges or environmental levies, or overdue tax or social security contributions under the law of its country of establishment, will also be excluded.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached a material term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty. Exclusion may also apply where the bidder has provided false information about meeting qualification criteria or failed to provide required information or supporting documents.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the procurement, including at least one contract worth EUR 100,000 or more excluding VAT. The bidder must provide a list stating each contract’s performance period, details of the other contracting parties and the customer representative’s contact details, including telephone number and email address, and the reference number for public contracts. The contracting authority may request evidence of proper performance if it cannot obtain the information from public or private databases without disproportionate cost.
For switching operations related to the works, the bidder must have an employee with the required switching authorisations, registered in Elektrilevi’s partner portal before tenders are opened. For low-voltage works (0.22–1 kV), low-voltage switching authorisation is sufficient. In other cases, both low- and medium-voltage switching authorisations are required (over 1 kV up to 20 kV), including where low-voltage work requires switching on the medium-voltage side. The bidder must also have a person appointed to be responsible for the work operation, registered in the same portal before tenders are opened.
The bidder must have a person directing electrical works who holds valid A-level competence and/or a qualification of at least level 6 under the Professions Act. The person must hold the relevant evidence by the tender submission deadline and be registered in Elektrilevi’s partner portal before tenders are opened.
The tender must include the price table in the form specified in the procurement documents, with every unit-price field completed. It must comply with the procurement documents; tenders with additional conditions or conditional tenders are not permitted. The bidder must provide the contract signatory’s name, job title and contact details, confirm the basis of the signatory’s authority, and provide the contact person’s details for contract matters. If the authority to represent the bidder does not arise from its articles of association, a power of attorney must be included. The bidder must identify and justify any information in its tender claimed as a trade secret; the tender price and figures used to assess the award criteria may not be designated as trade secrets.
The invoice payment period, calculated from receipt of the invoice by the contracting authority, is 14 calendar days for contracts up to EUR 59,999, 35 calendar days for contracts from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts of EUR 250,000 or more. If the bidder joins the contracting authority’s factoring programme, the payment period is 95 calendar days.
By submitting a tender, the bidder accepts all conditions in the procurement documents. The notice does not specify the award criteria; these should be checked in the procurement documents.
