Compliance requirements
The bidder may be excluded if the bidder or a person authorised to represent, manage or control it has, within the past five years or while an exclusion period remains in force, been finally convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or another form of human trafficking. Where legally permitted for this procurement, the bidder may provide evidence of measures taken to restore its reliability.
Exclusion grounds also include unpaid taxes or social security contributions in the relevant countries. The stated threshold is EUR 0; under Estonian rules, a tax-debt certificate is not issued when the relevant tax debt is below EUR 100 or payment has been deferred. A bidder may avoid exclusion by paying the amounts due or entering into a binding payment arrangement, including for interest and late-payment charges. Further grounds include enabling a foreign national to work without a legal basis or in breach of applicable employment conditions, and a contract award that would breach international or Estonian government sanctions. The bidder must provide the requested confirmations; additional information or evidence may be requested where there are reasonable grounds for doubt.
