Compliance requirements
The tenderer must declare whether it or any person empowered to represent, manage or control it has, within the last five years or while an exclusion period remains in force, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour or human trafficking offences. The declaration also covers breaches of tax and social security payment obligations, environmental, social or labour-law obligations, insolvency or comparable proceedings, serious professional misconduct, competition-distorting agreements, conflicts of interest, involvement in preparing the procurement, significant or persistent breaches of previous contracts, false or misleading information, failure to provide required information or documents, and attempts to obtain confidential information or improperly influence the procedure.
The grounds also include enabling a foreign national to work without legal grounds, being subject to international sanctions, and convictions for tax offences. The stated threshold for tax and social security arrears is EUR 0. Under the stated Estonian tax rules, a tax debt below EUR 100 (excluding interest not established by an administrative act) or a debt whose payment has been rescheduled is not certified as tax debt. Where a relevant ground applies, the tenderer may provide evidence of measures taken to restore its reliability where permitted for this procurement.
