Compliance requirements
The bidder must not be subject to mandatory exclusion grounds, including relevant convictions of the bidder or persons authorised to represent, manage or control it for offences such as participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, unlawful employment or human trafficking and unlawful use of child labour. The bidder must also have no outstanding tax, public levy or environmental charge debt under the applicable rules.
The contracting authority may also exclude a bidder that has seriously or persistently breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty. It may exclude a bidder that has provided false information about meeting qualification conditions or has failed to provide required information or additional documents.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months before the procurement began. At least one contract must have been worth €40,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the client’s representative and their contact details, including telephone number and email address, and the procurement reference number where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost.
The team must include a worker with valid switching rights for the switching operations required by the works in the 0.22–20 kV electricity network, excluding regional and distribution substations. For low-voltage-only works (0.22–1 kV), low-voltage switching rights are required; otherwise both low- and medium-voltage rights are required, including where low-voltage works require switching on the medium-voltage side (over 1–20 kV). The worker must be registered in Elektrilevi’s partner portal before bids are opened. The bidder must also have a person responsible for the work operation, registered in that portal before the bid submission deadline, and a person leading the electrical works with valid A-level competence or a qualification of at least level 6 under the Professional Qualifications Act. The latter must hold the relevant proof at the time of bid submission and be registered in the portal by the submission deadline.
The bid must accept the tender-document conditions without additions or reservations and include a completed price table in the required format, with every unit-price field filled in. The bidder must provide the contract signatory’s name, position and contact details, as well as the contract contact person’s details; a power of attorney must be included if signing authority does not arise from the articles of association. The bidder must identify and justify any trade secrets, but may not classify the bid price or other specified evaluation-related figures or indicators as trade secrets.
The standard payment period, counted from receipt of the invoice, is 14 calendar days for contracts up to €59,999; 35 days for contracts from €60,000 to €249,999; and 45 days for contracts of €250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
Bidders established in Russia or Belarus may not participate. Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. The supplied documents do not specify the award criteria.
