Compliance requirements
The contracting authority must exclude a bidder if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences relating to the illegal employment of foreign nationals or breaches of their employment conditions, including underpayment; or unlawful child labour or human trafficking. A bidder must also be excluded for outstanding state tax, duty or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment.
The contracting authority may exclude a bidder that has seriously or repeatedly breached a material term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty. It may also exclude a bidder that has provided false information about compliance with qualification requirements or failed to provide such information or requested supporting documents.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have a value of at least EUR 40,000 excluding VAT. Submit a list stating each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address) and, for public contracts, the reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant expense.
The team must include:
- A worker authorised to carry out switching operations on the 0.22–20 kV electricity network, excluding regional and distribution substations, and registered in Elektrilevi’s partner portal before the tender deadline. For works involving only low voltage (0.22–1 kV), low-voltage switching rights are sufficient; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side.
- A person designated as responsible for the work operation, registered in Elektrilevi’s partner portal before the tender deadline.
- A person leading electrical works who holds a valid A-class competence or a qualification of at least level 6 under the Vocational Qualifications Act, has the corresponding evidence as of the tender submission date, and is registered in Elektrilevi’s partner portal before the deadline.
The tender price must be submitted using the prescribed table, with every unit-price field completed. Conditional tenders or tenders containing additional conditions are not permitted. The bidder must provide the name, position and contact details of each person authorised to sign the contract, as well as the contract-performance contact person’s details; if signing authority does not arise from the articles of association, include a power of attorney. The bidder must confirm acceptance of the procurement documents’ requirements.
Standard payment periods, calculated from receipt of the invoice, are 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. Price is not identified in the provided documents as the sole award criterion, and no award scoring details are stated.
