Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant convictions of the bidder or persons with authority to represent, direct or control it for participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the illegal employment of foreign nationals or breaches of their employment conditions; child labour or human trafficking; outstanding taxes, duties or environmental charges, or unpaid tax or social security contributions; and contract award that would violate an international or Estonian government sanction. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty. It may exclude a bidder that has provided false information about compliance with qualification requirements or failed to provide required information or supporting documents.

Qualification criteria and exclusion grounds

The bidder must provide a completed Form 1 price table in euros excluding VAT. All fields marked for completion by the bidder must be filled in, and the listed items and quantities must not be changed. The bidder must have a person directing electrical work who holds a valid A-level electrical competency certificate or an electrical engineer qualification at level 6 or higher, and must provide evidence of that qualification. A bidder established outside Estonia must provide a confirmation and documents demonstrating equivalent competence or an equivalent electrical engineer qualification; the contracting authority will assess equivalence. The bidder must also ensure that one or more persons designated as C-persons responsible for work operations are available to perform the work. The bidder must provide the name, job title and contact details of the person or persons authorised to sign the contract, together with the basis for their authority. If that authority does not arise from the articles of association, a power of attorney must be included. The bidder must also designate a contact person for contract-performance matters. Joint bidders must appoint an authorised representative and submit the relevant power of attorney using the form provided in the procurement documents. The standard payment term is 45 calendar days from receipt of the invoice where the contract value is at least EUR 250,000. By joining the contracting authority’s factoring programme, the payment term is 95 calendar days from receipt of the invoice. The bidder must identify and justify any information in its tender that it considers a trade secret. The tender price, item prices and other figures or indicators used to assess the tender may not be designated as trade secrets. The bidder must confirm that its place of establishment is not in the Russian Federation or Belarus. Materials, equipment and goods, including components, installed or used in the work must not be produced in or originate from either country; the contracting authority may request certificates of origin. The tender must comply with the procurement documents, and conditional tenders are not permitted. No award criteria are specified in the supplied documents.
