Compliance requirements
The bidder must confirm in the ESPD that no exclusion grounds apply to it or, where relevant, to its management or supervisory body members and representatives. Grounds include relevant convictions within the preceding five years, including participation in a criminal organisation, corruption, fraud, terrorism, money laundering, human trafficking and the use of child labour; failure to pay taxes or social security contributions; breaches of environmental, social or labour-law obligations; bankruptcy, liquidation or another insolvency situation; serious professional misconduct, anti-competitive agreements, conflicts of interest or involvement in preparing the procurement; significant breaches of previous public contracts; and false statements, failure to provide required information, or improper attempts to obtain confidential information. Grounds also include enabling a foreign national residing in Estonia without a legal basis to work and entering into a contract with a person or entity subject to international or Estonian sanctions. A conviction for tax offences is a discretionary ground for exclusion. If an exclusion ground applies, the bidder may submit evidence of measures taken to restore its reliability where permitted by law or the procurement documents. A tax-debt certificate is not issued, among other cases, where the debt is below EUR 100 or payment has been deferred.
Qualification criteria and exclusion grounds
The bidder must have at least one fire alarm system maintenance specialist holding a level 5 responsible security systems specialist professional certificate, or an equivalent qualification, specialising in the installation and maintenance of fire alarm systems. The bidder must also have at least four technicians holding a level 4 security systems technician certificate, or an equivalent qualification, with the same specialisation. The names of these personnel must be provided in the ESPD. A copy of a professional certificate issued abroad must be provided at the buyer’s request. A specialist from another undertaking may be relied on only if that specialist performs the work requiring the relevant qualification under the framework agreement; the other undertaking’s ESPD and required confirmations must also be provided.
The participation application must be submitted using Form II of Annex 4. For a joint bid, the authorisation of the joint bidders and their confirmation of joint and several liability must be submitted in accordance with Form I of Annex 4. The bidder must confirm that its bid complies with the procurement documents and the technical description in Annex 2; any equivalent solution must be explained and supported by evidence. Prices must be submitted using the form in Annex 5 and the prescribed structure in the procurement register’s pricing form. The Annex 5 form must not be altered, and the prices submitted must be final, with no additional payments or costs. The bidder must identify and justify any trade secrets; bid prices and numerical figures used to assess bids may not be designated as trade secrets.
