Compliance requirements
The bidder must not be subject to exclusion grounds relating to convictions of the bidder or its representatives for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, the use of child labour or human trafficking (generally within the past five years). Other grounds may include failure to pay taxes or social security contributions; bankruptcy or insolvency; liquidation; an arrangement with creditors; suspension of business; serious professional misconduct; agreements restricting competition; an unavoidable conflict of interest; or involvement in preparing the procurement in a way that creates an unjustified advantage.
Exclusion grounds may also include a material or repeated breach of an earlier public contract resulting in early termination, damages or another sanction; false statements, failure to provide required information or documents, or improper acquisition of confidential information; breaches of environmental, social or labour-law obligations; enabling the employment of a foreign national without a legal basis; or conviction for a tax offence. The bidder must confirm that entering into the contract would not breach international or national sanctions. Where exclusion is mandatory, the statutory exclusion rules apply; remedial measures to restore reliability may be submitted only where permitted.
Qualification criteria and exclusion grounds
The bidder must submit an unconditional tender, confirm compliance with the tender documents, and provide the details of the person authorised to sign the contract and the contract performance contact person. The tender must follow the technical specification and offer form, with prices entered in the prescribed structure. Manufacturer-issued technical documentation must be supplied so that the buyer can verify the products’ characteristics and compliance.
Samples of every product offered must be provided in the quantities specified for each lot in the technical specification. Samples must be delivered before the tender opening deadline in a sealed, labelled package to the address specified by the buyer. The package must show the procurement title, reference number and bidder’s name. A tender may be declared non-compliant if samples are not submitted on time. The bidder must confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. The bidder must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers covered by the Russia-related sanctions rule, including Russian nationals or residents, entities established in Russia, or entities owned or controlled by them.
