Compliance requirements
The bidder, its management, administrative or supervisory body members, and persons authorised to represent, make decisions for, or control it must not have been finally convicted within the past five years of participation in a criminal organisation, corruption, fraud, terrorist offences or related activity, money laundering, terrorist financing, unlawful use of child labour, or human trafficking. This does not apply where the exclusion period imposed by the judgment has ended or a remedy demonstrating restored reliability is available.
Grounds for exclusion also include unpaid national taxes, duties, environmental charges, or social security contributions. In Estonia, a tax-debt certificate is not issued where the debt for taxes administered by the same tax authority, excluding interest not established by an administrative act, is below EUR 100 or payment has been deferred. For a foreign bidder, the rules of its country of establishment apply. Other grounds include a penalty for enabling a foreign national staying in the country without a lawful basis to work, or for breaching the conditions for a foreign national’s employment in Estonia, and circumstances in which awarding the contract would violate an international or Estonian government sanction. The bidder must provide the relevant declarations in the ESPD; where applicable, it may describe measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must submit an unconditional tender and confirm that it complies with the procurement documents. The tender must identify both the person who will sign the contract if awarded and the contract-performance contact person. If the contract is to be signed under a power of attorney, that document must be included.
The tender must include the completed Annex I technical specification and tender form, as well as pricing in the structure specified in the sheet for award criteria and evaluated indicators. Manufacturer’s information and relevant documents must support the declared technical characteristics; examples include certificates of conformity, catalogues, operating and maintenance instructions, and technical data. For each product, the bidder must provide a manufacturer’s document confirming CE marking and compliance with Medical Devices Regulation (EU) 2017/745 (MDR).
If the proposed product is not already in use at the hospital by the tender submission deadline, the bidder submitting the lowest-priced tender must provide samples for testing within 5 working days of the contracting authority’s notice. Samples must be delivered, by prior arrangement with the contact person, to Ravi 18/2, Tallinn, Building H. The authority may order additional product samples, which must be delivered within 7 calendar days of the order. Late or incomplete delivery, or non-compliance with the technical specification, may result in rejection of the tender.
If the tender proposes an equivalent solution to one named in the procurement documents, the bidder must explain the equivalence and provide supporting evidence. The bidder must confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions. It must also confirm that subcontractors or suppliers who are Russian citizens, residents, or entities established in Russia, or are owned by or act under the instructions of such persons or entities, will not be involved in performing more than 10% of the contract value. The bidder must identify and justify any information it considers a trade secret; tender prices and indicators related to the award criteria may not be classified as trade secrets. The provided documents state no separate turnover, past-experience, or team-qualification thresholds.
