The ESPD requires the bidder to declare whether, within the relevant period, it or its representatives have been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. It also covers unpaid taxes or social security contributions; insolvency, bankruptcy, liquidation, suspension of business or arrangements with creditors; serious professional misconduct; agreements intended to distort competition; conflicts of interest or involvement in preparing the procurement; serious or repeated failures under previous contracts resulting in early termination, damages or comparable sanctions; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information improperly; and breaches of environmental, social or labour-law obligations. National grounds also cover enabling unlawful employment of foreign nationals, contracting with a person subject to international sanctions, and tax-related offences. The tax and social contribution section sets a threshold of EUR 0 and notes that, under Estonian rules, a tax-debt certificate is not issued for debt below EUR 100 or where payment has been deferred. If a ground applies, the bidder may, where permitted, provide evidence of measures taken to restore its reliability.

The supplier must demonstrate experience selling every product offered in the tender: during the three years preceding publication of the contract notice, it must have sold at least one third of the quantity planned for that product over the framework agreement period. Provide a list of completed sales contracts or transactions, stating the exact product sold, quantity, contract dates and value, and the other contracting parties; submit the confirmation and sales details in the ESPD. The supplier must also have a product representative who has received training from the manufacturer or completed training on the offered products. Name the representative in the ESPD and, if requested, provide training certificates or the manufacturer’s written confirmation of the training. The bid must include all product names and sizes for the relevant lot, a completed Appendix 1 in Excel format, and manufacturer-issued technical specifications, instructions for use and other materials in Estonian or English demonstrating compliance with the technical requirements. The supplier must document its right to represent and sell the products in Estonia, provide transport and delivery procedures approved by the company manager, and submit applicable CE conformity certificates or declarations under Regulation (EU) 2017/745 or its transitional provisions. Product and transport packaging label images or scans must show the required identification and traceability details. Submit product samples as specified in Appendix 1 unless the product has been in use at the hospital under a contract with the supplier during the two years preceding publication of the notice. Samples must arrive by the bid deadline; any additional samples requested for practical testing must be delivered within three working days. Submit the participation application in the Appendix 3, Form II format. Prices must follow the prescribed structure, be stated in euros to two decimal places for each product and as a total per lot, and include all delivery and unloading costs. Where joint bidders submit a bid, provide the Appendix 3, Form I power of attorney and confirmation of joint and several liability. The bidder must confirm that the offer complies with the procurement documents; any claimed equivalence must be explained and supported with evidence.
