Compliance requirements
The ESPD requires the bidder to declare whether it or its relevant representatives have grounds for exclusion, including final convictions within the previous five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activity; serious professional misconduct; competition-distorting agreements; conflicts of interest or involvement in preparing the procurement; serious or repeated breaches of previous contracts; false or misleading information, failure to provide requested information or documents, or improper efforts to obtain confidential information; and breaches of environmental, social or labour obligations. National grounds also cover enabling unlawful employment of foreign nationals, being subject to international sanctions, and convictions for tax offences. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The provided documents do not state specific financial-capacity, turnover, experience or technical qualification thresholds. For each lot bid for, the bidder must submit the completed price form, price all goods listed in that lot’s basket and complete all required fields. The form’s structure must not be changed, and bidders may not add conditional or restrictive qualifications. The price must follow the prescribed submission structure, and conditional bids are not allowed. The bidder must confirm compliance with the tender documents; where an equivalent product or solution is offered, explain the equivalence and provide supporting evidence. The bidder must confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. The bidder must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that fall within the specified Russian ownership, establishment, residency or representation restrictions. Joint bidders must appoint an authorised representative and include the relevant power of attorney. Any information claimed as a trade secret must be identified and justified; prices and price components cannot be designated as trade secrets.
