Compliance requirements
The bidder must confirm that the company, its management or supervisory board members, and persons authorised to represent or control it have not received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, or offences involving child labour or human trafficking. There must also be no current exclusion period. Where applicable, the bidder must describe measures taken to restore its reliability and provide supporting evidence.
The bidder must not have outstanding tax or social security payment obligations. A tax debt certificate is not issued, among other cases, where the debt for taxes administered by the same tax authority is below EUR 100 or payment of the debt has been deferred; a foreign bidder must provide evidence compliant with the rules of its country of establishment. The bidder must also confirm that it has not enabled an unlawfully residing foreign national to work or breached the conditions for employing a foreign national in Estonia, including remuneration requirements.
The bidder must confirm that entering into the contract would not breach an international sanction or a sanction of the Republic of Estonia. If there are justified doubts, the contracting authority may request additional information or evidence.
Qualification criteria and exclusion grounds
The machine-readable procurement passport does not specify concrete turnover, previous experience, certificate or staffing qualification requirements. However, the bidder must submit technical evidence concerning the video surveillance recording system servers confirming compliance with the technical specification (Appendix 1). The technical tender must be sufficiently detailed to allow the contracting authority to verify the servers’ compliance; the authority may ask additional questions and request further evidence.
A completed price form in Appendix 3 must be included with the tender. If the price entered in the register conflicts with the price in the form, the contracting authority will rely on the form. The bidder must also provide the name of the person signing the contract; if that person is not a management board member, a power of attorney must be attached. The name, email address and telephone number of the contractual contact person must also be provided.
For a joint tender, the joint bidders must appoint an authorised representative from among themselves and attach a power of attorney. The bidder must confirm that the tender complies with the procurement documents and, where necessary, explain equivalence and provide evidence of equivalence. The bidder must also confirm that the goods offered are not subject to an international sanction and do not originate from a sanctioned region. Any trade secret must be identified separately in the tender and the designation must be justified; the tender price may not be classified as a trade secret.
