Compliance requirements
The tenderer must confirm that neither the company nor its management, supervisory or authorised representatives have been finally convicted within the relevant five-year period, or remain subject to an exclusion obligation, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking.
The tenderer must not have outstanding tax or social-security payment obligations. The notice states that a tax-debt certificate is generally not issued where the debt managed by the same tax authority is below EUR 100, excluding undetermined interest, or where payment has been deferred. The tenderer must also confirm compliance with the national exclusion grounds concerning the employment of unlawfully present foreign nationals, breaches involving the statutory remuneration requirement, and international sanctions. If an exclusion ground exists, the tenderer may provide evidence of remedial measures where legally permitted or provided for in the procurement documents. The required confirmations and, where applicable, supporting evidence must be submitted with the tender documentation.
Qualification criteria and exclusion grounds
The tenderer must have the waste-management permit and handling licence required for the works, or an agreement with a waste-management company. A confirmation of the permits or agreement must be submitted; a written commitment to obtain the permit and licence or conclude the waste-management agreement for contract performance is also accepted.
Within the 36 months preceding the publication of the tender, the tenderer must have properly performed at least two contracts in a similar field, namely green-area maintenance works. Each contract, or the contracts in the required scope, must have a total value of at least EUR 25,000 excluding VAT. Contracts may still be in progress at the time of tender submission, but the required volume of work must already have been completed properly and in accordance with good practice. The tenderer must provide a list of the relevant works and identify the client, contract value and client contact details.
The tenderer must have, or be able to obtain or hire, the minimum machinery and equipment required to perform the service and works. The machinery and equipment must be specified using Annex 3. If the listed equipment is insufficient for the workload and service quality, the tender must identify an alternative quantity of machinery and equipment with the necessary technical capacity.
The tender must comply with the procurement documents, may not be conditional, and must follow the prescribed price structure and separate price table in Annex 2. Where equivalence is relied upon, the tenderer must explain it and provide supporting evidence. For a joint tender, the joint tenderers must appoint an authorised representative and submit the required authorisation.
