Compliance requirements

The bidder must confirm that the company, its management or supervisory board members, and persons authorised to represent, decide for or control it have not been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorist financing, illegal use of child labour or human trafficking, and that no exclusion period remains in force. The bidder must not have outstanding taxes or social security contributions, and entering into the contract must not breach an international or Estonian sanction. Allowing an unlawfully residing foreign national to work in Estonia or breaching the conditions for a foreign national’s employment, including paying less than the statutory wage rate, is also an exclusion ground. The bidder must provide the required confirmations, and the contracting authority may request additional information or evidence where there is justified doubt.

Qualification criteria and exclusion grounds

The bidder must be registered in the appropriate business register of its country of establishment. For a bidder established in Estonia, the registration will be checked in the Commercial Register; a foreign bidder must provide registration evidence at the contracting authority’s request. By the tender submission deadline, the bidder must hold a valid wholesale medicinal products licence under the Medicinal Products Act. The licence will be checked in the State Agency of Medicines licence register. The tender must include Annex 1 to the procurement documents, with all required beige or pink fields completed. It must comply with all conditions set out in the contract notice and tender documents; conditional tenders are not permitted. The bidder must state the product unit price in euros excluding VAT, to two decimal places, using the prescribed electronic structure. The unit-price amount in section 4 of Annex 1 must match the amount entered in the procurement environment. For a joint tender, a power of attorney appointing an authorised representative must be attached. Any trade secret must be identified separately and justified; the tender price and evaluation-related numerical indicators for supplies may not be designated as trade secrets.
