Compliance requirements
The bidder must confirm that neither the bidder nor its management or supervisory board members, procurists, or other persons authorised to represent or control it have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering, terrorist financing, unlawful employment of a foreign national, breaches of a foreign national’s employment conditions, illegal use of child labour, or trafficking in human beings. Tax, public payment, environmental charge, or tax and social security contribution debts are also grounds for exclusion. The contracting authority may also exclude a bidder for a serious or repeated breach of a previous public contract, including termination, price reduction, compensation, or a contractual penalty, or for submitting false qualification information or failing to provide required information or documents. Companies established or resident in the Russian Federation or the Republic of Belarus may not participate.
Qualification criteria and exclusion grounds
Within the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this procurement. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information about the other contracting parties, the client representative’s contact details, and, for public contracts, the reference numbers. Proof of proper performance must be provided upon request unless the contracting authority can obtain the information from public or private databases without significant expense. The team must include a person with valid switching authorisations for switching operations in a 0.22–20 kV electricity network. For low-voltage works only, at least MP switching authorisations are required; in other cases both MP and KP switching authorisations are required. This person must be registered in Elektrilevi’s partner portal before the tenders are opened. The team must also include a person responsible for the work operation, registered in the same portal before the tender submission deadline. In addition, the team must include a person leading the electrical works who holds valid A-level competence and/or a qualification corresponding to at least level 6 under the Estonian Occupational Qualifications Act, possesses the relevant evidence, and is registered in Elektrilevi’s partner portal before the tender submission deadline. The tender must comply with the procurement documents; conditional tenders or tenders containing additional conditions are not permitted. A fully completed price table, details of the contract signatory and contact person, and, where necessary, a power of attorney must be submitted. The bidder must identify and justify any trade secret; the tender price and prohibited evaluation-related figures may not be classified as trade secrets. Materials, equipment, goods, and components used in the works may not be manufactured in or originate from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin. The standard payment periods are 14 calendar days for a contract value up to EUR 59,999, 35 calendar days for EUR 60,000–249,999, and 45 calendar days for EUR 250,000 or more. A 95-calendar-day payment period applies if the bidder joins the contracting authority’s factoring programme.
