The tender passport asks the bidder to declare whether any exclusion grounds apply. These include relevant criminal convictions of the company or its representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unresolved conflict of interest or improper involvement in preparing the procurement; serious failures under previous contracts, including early termination or damages; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information improperly; enabling unlawful employment of foreign nationals; international sanctions; and certain tax offences. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.

The bidder must have had net turnover of at least EUR 35,000 in the last financial year completed by the start of the procurement. Joint bidders may aggregate their figures. The bidder must also have completed at least one similar contract during the 36 months preceding the start of the procurement, with a value of at least EUR 25,000 excluding VAT. The reference must concern development and/or maintenance of an information system using Microsoft SharePoint and include analysis, architecture, software development, testing, role-based user management and data-processing functionality, as well as workflow automation and user-interface development. At the contracting authority’s request, the bidder must provide client confirmation of proper performance, the contract period and value, and a description showing that the reference meets the requirements. The contract must be performed by a development team of at least three people; key personnel must be able to work with the contracting authority in Estonian and use technical and functional specifications in Estonian and English. The bidder must confirm that the proposed team meets the requirements in the tender documents. If relying on another entity’s turnover or technical capacity, the bidder must provide the required information and that entity’s commitment; the entity whose turnover is relied upon is jointly liable for the relevant part of the contract, and an entity providing technical capacity must participate directly in the contract performance. The offer must accept the tender conditions. The bidder must identify any business secrets and explain why they qualify; the price and numerical figures relating to evaluation criteria may not be designated as business secrets.
