The bidder must confirm that neither it nor its management, administrative or supervisory body members or representatives is subject to any exclusion ground. The checks cover, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, the use of child labour or human trafficking, breaches of tax and social security payment obligations, breaches of environmental, social or labour law, bankruptcy and other insolvency situations, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement procedure, serious breaches of previous contracts, and the submission of false information or failure to submit required documents. The contract must also not violate international or Estonian sanctions law, and the bidder must not be subject to an exclusion ground concerning the employment of unlawfully residing foreign nationals or convictions for tax offences. The bidder must be able to provide relevant evidence and explanations where required; regarding taxes and social security contributions, it must provide a declaration or enable the contracting authority to verify the information.

The bidder must have completed at least one leasing agreement similar to the subject of this procurement during the 36 months preceding the launch of the procurement procedure. The bidder must provide the contract details, including a description, value, performance period, client name and contact details, and the bidder’s area of responsibility. The tender must be submitted by the bidder’s legal or authorised representative. If submitted by an authorised representative, a power of attorney must be included with the tender. In the case of a joint tender, the joint tenderers must appoint an authorised representative from among themselves and submit a power of attorney for the joint tenderers. The tender price must be provided on the prescribed technical specification and price schedule (Annex 3) and in the public procurement register. The tender must also include a detailed description of the vehicle offered, including additional equipment and precise information about the vehicle. The bidder must identify which information in the tender constitutes a trade secret and provide reasons; the tender price and other numerical indicators used for evaluation may not be designated as trade secrets.
