Compliance requirements
A bidder may be excluded if, during the previous 12 months, it materially breached a procurement contract concluded with the contracting authority, or if a dispute is pending with the contracting authority concerning an alleged material breach during that period. The bidder must not be subject to any exclusion grounds under Section 95(1) of the Estonian Public Procurement Act. The bid must identify any information claimed as a business secret and explain the justification, or state that the bid contains no business secrets. The bid price, instalment amounts and other numerical indicators related to the bid evaluation criteria may not be classified as business secrets. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas; otherwise, the bid may be rejected.
