Procurement of computer workplace management services

A bidder must be excluded if it, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences relating to the unlawful employment of foreign nationals or breaches of their employment conditions, including paying below the statutory wage rate; or illegal child labour or human trafficking. Exclusion also applies where the bidder has outstanding national tax, payment or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment, or where awarding the contract would breach an international or Estonian government sanction. Only bidders established in an EU Member State, an EEA contracting state or a state party to the WTO Government Procurement Agreement may participate. Bidders established outside those states will be excluded.

The bidder’s net turnover or sales revenue must have been at least EUR 100,000 in each of the last three financial years completed by the start of the procurement. If relying on another entity’s financial resources, the bidder and that entity must submit a jointly signed confirmation that the resources are available, will be used to perform the contract, and that both parties accept joint and several liability for the relevant part of the contract. During the last three years, the bidder must have performed at least two contracts for maintenance services for information technology equipment that are similar or equivalent to this procurement. Each contract must cover at least 100 computer workstations, and at least one contract must cover equipment located in more than one country. Ongoing contracts are accepted if they meet these conditions. The bidder must confirm proper performance and provide the contract name or number, a brief description, the performance period, and the other party’s details, including a contact telephone number and email address; for public contracts, the procurement reference number must also be given. The contracting authority may verify the information with the other party. If relying on another entity’s technical or professional capacity, that entity must personally perform the relevant contract or part of it, and both parties must submit a jointly signed confirmation of the resources, their use and joint and several liability. The bidder’s IT equipment maintenance and user-support processes must meet ISO 9001 or an equivalent quality standard. A copy of a valid certificate issued by an accredited certification body must be submitted; equivalent evidence of quality assurance measures may also be accepted. During contract performance, maintenance engineers working in Region 1 must have Estonian language proficiency of at least B2. Engineers working in Regions 2 and 3 must have English proficiency of at least B1. The offer must comply with the procurement documents, be unconditional, and follow the prescribed pricing structure. Where equivalence is relevant, the bidder must explain it and provide supporting evidence. A consortium must appoint an authorised representative and submit the required power of attorney. The bidder must identify and justify any information claimed as a trade secret; the offer price and evaluation-related numerical figures may not be designated as trade secrets. The required participation statement and detailed price form must also be submitted.
