Compliance requirements
The bidder and relevant persons authorised to represent, manage or control it must not have applicable convictions within the last five years, or an active exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. The bidder must not have unpaid tax or social security obligations under the applicable rules. In Estonia, tax-debt evidence is generally not issued for debt below EUR 100 or where payment has been rescheduled.
Exclusion may also apply if the bidder has provided false information, withheld required information or documents, failed to supply requested supporting documents, improperly influenced the procurement or sought confidential information to gain an unfair advantage. A mandatory domestic ground applies to convictions for enabling an unlawfully present foreign national to work or breaching conditions for a foreign national’s employment, including paying below the statutory wage rate. The bidder must not be subject to an international or Estonian government sanction that would make contract award unlawful.
Participation is restricted to bidders established in Estonia, another EU Member State, an EEA contracting state or a country party to the WTO Government Procurement Agreement. Bidders established in Russia or Belarus may not participate. Where permitted, a bidder may provide evidence of remedial measures to demonstrate restored reliability.
Qualification criteria and exclusion grounds
The bidder must hold a valid Police and Border Guard Board activity licence for providing security services in the “guarding” field. The licence number must be stated in the ESPD; the contracting authority will verify the licence in the register. For this service contract, the bidder may not rely on another entity to meet the licence or registration requirement.
The bidder must provide at least two properly performed contracts for manned security services at a site subject to the Ports Act and the ISPS Code. The services must have been provided for at least 12 consecutive months within the 36 months preceding publication of the contract notice. The ESPD must list each contract, including the client’s name and contact details, the site and service description, whether the Ports Act and ISPS Code applied, and the contract period. If the contract resulted from a public procurement, its reference number must also be given.
The bidder must appoint a security manager responsible for organising and managing the service and for contract performance. The manager must hold Security Manager, level 5 (or equivalent), and a Port Facility Security Officer qualification under the ISPS Code. Evidence of both qualifications must be provided; foreign qualifications require proof of recognition by the competent Estonian authority.
The security guard or guards directly providing the service must hold at least Security Guard, level 4 (or equivalent), have Estonian language proficiency at B2 level and conversational proficiency in Russian and English, and have completed a 16-academic-hour first-aid provider course (or equivalent). Refresher training of 6 academic hours is required every three years. Before contract signing, the successful bidder must provide evidence of each guard’s qualifications and first-aid training; foreign qualifications require proof of Estonian recognition.
The bidder must visit the service location at Roomassaare Port and register the visit as instructed in the tender documents. The bid must comply with all tender-document requirements, be unconditional, and include all costs of performing the contract. It must follow the specified price-submission structure. The person submitting or digitally signing the bid must be authorised to represent the bidder; if that authority is not evident from the register, a power of attorney is required. Joint bidders must appoint an authorised representative and submit a power of attorney signed by all of them; they are jointly and severally liable for contract performance.
