Compliance requirements
A bidder must be excluded if the bidder or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving illegal employment or breaches of rules on employing foreign nationals in Estonia, including paying less than the statutory minimum wage; or unlawful use of child labour or human trafficking. A bidder must also be excluded for outstanding state tax, fee or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. The contracting authority may exclude a bidder for serious or persistent breaches of previous public contracts that led to termination, withdrawal, a price reduction, damages or a contractual penalty, or for providing false information or failing to submit required qualification information or documents.
Qualification criteria and exclusion grounds
The bidder must have properly performed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 35,000 or more, excluding VAT. The bidder must submit a list showing each contract’s performance period, the other contracting party’s details (including the customer representative’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper performance must be provided if requested, unless the contracting authority can obtain it from databases without significant cost.
The bidder’s team must include a person authorised to carry out the required switching operations on the 0.22–20 kV electricity network, excluding regional and distribution substations. The required rights depend on the work: for low-voltage-only works (0.22–1 kV), at least low-voltage switching rights are required; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side. The person must be registered in Elektrilevi’s partner portal before the deadline for submission of tenders. The team must also include a person responsible for the work operation, registered in that portal before the same deadline, and a person leading the electrical works who holds valid A-class competence and/or a qualification of at least level 6, has the corresponding evidence at the time of tender submission and is registered in the portal before the deadline.
The tender must comply with the procurement documents; conditional tenders or tenders containing additional conditions are not permitted. The bidder must submit the price in the prescribed table and complete every unit-price field, taking account of the applicable instructions for document V178. The bidder must provide the contract signatory’s name, position and contact details, as well as a contact person for contract-performance matters; a power of attorney must be included if signing authority does not arise from the articles of association. Joint bidders must appoint an authorised representative and provide the relevant power of attorney.
The bidder must state whether the tender contains trade secrets and justify any such designation; the tender price and relevant evaluation figures cannot be designated as trade secrets. Companies established in Russia or Belarus may not participate, and materials, equipment, goods or components produced in or originating from those countries may not be installed or used. The contracting authority may request certificates of origin. The bidder must also indicate its acceptance of the applicable payment period: 14 calendar days for contracts up to EUR 59,999; 35 days for contracts from EUR 60,000 to EUR 249,999; or 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme entails a 95-calendar-day payment period.
