Qualification criteria and exclusion grounds
The bidder must have provided owner’s supervision services for works similar to the subject of this procurement and must have properly completed at least two similar owner’s supervision contracts during the 36 months preceding the date on which the contract notice was published in the national public procurement register. At least one reference contract must concern owner’s supervision for the construction or reconstruction of a building or group of rooms with enhanced hygiene, process and building-services requirements, such as a food-processing facility, food technology facility, food laboratory, research laboratory, test kitchen, product development facility, pilot production facility or equivalent, with a net area of at least 700 m². The second reference must concern owner’s supervision for the construction or reconstruction of a building or part of a building with a net area of at least 1,500 m² and must include supervision of all the specified specialist building-services works; enhanced hygiene, laboratory, food-safety, process or special building-services requirements are not required for this second reference. The bidder must submit a list of the reference projects with the clients’ contact details and, where the contracts resulted from public procurement procedures, the relevant procurement reference number. At the contracting authority’s request, the bidder must provide client confirmation that the works met the stated conditions and were properly performed.
The responsible owner’s supervision specialist must hold at least a level 7 diploma civil engineer qualification, specialising in building construction and including owner’s supervision competence, or an equivalent qualification. The project team must include specialists with the relevant professional qualification and owner’s supervision competence, or equivalent: a level 7 diploma civil engineer; a level 7 diploma electrical engineer or a level 7 diploma electrical engineer specialising in electrical automation; a level 8 authorised heating, ventilation and cooling engineer; and a level 7 diploma water supply and sewerage engineer. The qualification level must be higher where required by the currently applicable professional standard. The bidder must provide the proposed specialists’ details and evidence or references for checking their qualifications. Foreign qualifications must be at least equivalent; translations into Estonian and evidence of equivalence must be submitted where necessary. The successful bidder must provide signed consents from the proposed specialists to participate in contract performance if requested.
The bid must comply with all procurement-document requirements and may not be conditional. The bidder must submit the detailed price table in accordance with Annex 3 of the simplified procurement documents and provide the price in the structure specified on the evaluation criteria and evaluated indicators sheet. The contractor must have professional liability insurance with a minimum indemnity limit of EUR 100,000 and must undertake to conclude and submit insurance meeting this requirement by the deadline stated in the works contract. Joint bidders must appoint an authorised representative and submit the relevant power of attorney. Any business secret must be identified and justified; the bid price and other prohibited evaluation-related figures may not be declared business secrets. The bidder must confirm timely performance within the deadlines set out in the procurement documents and irrevocably consent to set-off against the contract payment if performance is delayed for reasons attributable to the bidder.
