Compliance requirements
A bidder must be excluded if it or a person authorised to represent, direct or control it has been convicted of participation in a criminal organisation, breach of integrity or corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal employment of foreign nationals, or offences involving child labour or human trafficking. A bidder must also be excluded for outstanding taxes, social security contributions or environmental charges. The contracting authority may additionally exclude a bidder for serious or repeated breaches of previous public contracts that led to termination, withdrawal, a price reduction, compensation or a penalty, or for providing false qualification information or failing to submit requested information or documents. Participation is not permitted for entities established or resident in Russia or Belarus.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have been worth EUR 40,000 or more excluding VAT. The bidder must submit a list stating each contract’s performance period and the other contracting party’s details, including a contact person’s telephone number and email address; public procurement reference numbers must also be provided where applicable. Evidence of proper completion must be supplied on request unless the contracting authority can obtain it from databases without significant cost.
Before bids are opened, the bidder must have registered in Elektrilevi’s Partner Portal (EPP) a worker holding the switching authorisations required for the work. For low-voltage-only work, low-voltage switching authorisation is sufficient; otherwise, both low- and medium-voltage authorisations are required, including where medium-voltage switching is needed for low-voltage work. The bidder must also have an appointed person responsible for the work operation, registered in EPP before bids are opened, and a person leading the electrical works who holds valid A-level competence or a qualification of at least level 6 and is registered in EPP before bids are opened.
The bid must include the price table in the required format, with every unit-price field completed, and must comply with the instructions in document V178. Conditional bids or bids adding conditions are not permitted. The bidder must provide the contract signatory’s name, position, contact details and proof of authority to sign, as well as a contact person for contract matters; a power of attorney must be included if the authority does not arise from the articles of association. Materials, equipment and goods, including components, installed or used in the works must not originate from Russia or Belarus; the contracting authority may request certificates of origin.
