Compliance requirements
A bidder will be excluded if it or a person authorised to represent, manage or control it has been convicted of offences including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, or enabling illegal employment or unlawful use of foreign workers, including underpayment. A bidder will also be excluded for outstanding tax, social security contribution or environmental charge debts. The contracting authority may exclude bidders that have seriously or repeatedly breached important terms of a previous public contract, or provided false information about meeting qualification requirements or failed to provide requested supporting documents. Companies established in Russia or Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have been worth EUR 40,000 or more, excluding VAT. The bidder must submit a list stating the contract performance periods, details and contact information for the other contracting parties, and public procurement reference numbers where applicable. Supporting evidence of proper performance must be provided if requested, unless the contracting authority can obtain it from databases without significant expense.
The bidder must have an electrical works manager with valid A-level electrical competence and/or a qualification of at least level 6 under the Vocational Qualifications Act. The person must hold the relevant evidence and be registered in Elektrilevi’s Partner Portal (EPP) before tenders are opened. The bidder must also have a person with valid switching rights for the switching operations required by the works, registered in EPP before tenders are opened. For low-voltage-only works (0.22–1 kV), at least low-voltage switching rights are required; otherwise, both low- and medium-voltage switching rights are required, including where medium-voltage switching is needed for low-voltage works. A person responsible for the work operation must also be registered in EPP before tenders are opened.
The tender must include the completed price table using the prescribed form, with every unit-price field filled in, and must follow the instructions in management-system document V178. The bidder must provide the contract signatory’s name, title, contact details and evidence of authority to sign; if that authority does not arise from the articles of association, a power of attorney must be included. The bidder must also name a contact person for contract matters and identify and justify any information claimed as a trade secret. Materials, equipment and goods installed or used in the works, including components, must not originate from Russia or Belarus; the contracting authority may request certificates of origin.
