The bidder must confirm that none of the mandatory exclusion grounds apply. These include final convictions of the bidder or relevant representatives for participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling the illegal employment or unlawful stay of foreign nationals, including paying below the statutory minimum wage; unlawful use of child labour or trafficking in human beings; outstanding state taxes, payments or environmental charges, or outstanding tax or social security contributions under the law of the bidder’s country of establishment; and circumstances in which awarding the contract would breach an international or Estonian government sanction. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an important condition of a previous public contract, resulting in withdrawal from or termination of the contract, a price reduction, compensation for damage or a contractual penalty. A bidder may also be excluded for submitting false information or failing to submit information or additional documents requested by the contracting authority. The bidder must submit the required confirmation that no exclusion grounds apply.

The bidder must have completed or be performing at least one waste transport service contract with a duration of at least six months during the 36 months preceding the start of the procurement. The bidder must submit a list of waste transport contracts performed during the last 36 months, including the performance period, value and information about the other contracting parties. The bidder must hold a waste-handler registration authorising the transport of waste in Lüganuse municipality and must provide the registration details. The bidder must transport the waste to compliant waste treatment facilities, confirm this in the tender, and identify the intended facility or facilities by type of waste. The tender must be submitted by the bidder’s legal or authorised representative. If the signatory is not a management board member listed in the registry card, a power of attorney must be submitted. The tender price must be submitted using the required price form and in the procurement register, must be final, and must include all costs related to performing the contract. The bidder must complete the required price form and disclose any information claimed as a trade secret, including the reasons for that classification, or state that the tender contains no trade secrets.
