Compliance requirements
The bidder must declare whether it or its representatives have relevant convictions within the preceding five years, including for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. The grounds also cover unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, court or liquidator administration, or suspended business activity; serious professional misconduct; agreements intended to distort competition; conflicts of interest or involvement in preparing the procurement that cannot otherwise be remedied; and serious or repeated failures under previous contracts resulting in early termination, damages or comparable sanctions.
Exclusion may also apply where the bidder has submitted false information, withheld required information or documents, improperly sought confidential information, or committed the specified domestic-law offences, including enabling unlawful employment of a foreign national, being subject to applicable international sanctions, or having been convicted of tax offences. A contracting authority may also apply the stated domestic-law grounds concerning local tax debt or restrictions on the bidder’s place of establishment. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have civil liability insurance of at least EUR 20,000 covering personal injury and property damage caused to third parties and the contracting authority’s property. Evidence of the insurance must be provided after the bid is selected as successful. The insurance must remain in force throughout the contract, and the bidder must not cancel or change it in a way that removes cover. At the contracting authority’s request, the bidder must provide further evidence that the necessary funds are available or can be obtained to cover potential losses arising from a breach of contract.
During the 36 months preceding the deadline specified in the contract notice, the bidder must have completed at least three property management and maintenance service contracts, each worth at least EUR 20,000 excluding VAT. The bidder must provide details of the contracts, including their value, dates, clients and contact persons.
The bidder must confirm that its bid complies with all tender-document requirements and is not conditional, and must submit its price using the prescribed pricing structure. Before submitting a bid, the bidder must visit the contract performance site; a bid may not be submitted without this visit.
The bidder must also meet the specified environmental requirements for cleaning services and products. Before services begin, it must train staff on environmental impacts, including correct dilution and dosing of cleaning products, wastewater disposal and waste sorting, and provide evidence recording the training date, trainer, participants and topics. During the contract, it must monitor and record the specified cleaning indicators for at least one full working day every four months, including product use, cleaning supplies, water use and disposal, and solid waste and sorting. It must minimise environmental impacts through appropriate product use, eco-labelled products where available, reduced use of disposable supplies, efficient water use and waste reduction and sorting. These monitoring and procedure requirements do not apply where the bidder has an ISO 14001-certified or EMAS-registered environmental management system, or an applicable indoor cleaning ecolabel; the relevant certificate or proof must then be provided.
The bidder must submit lists and evidence for cleaning products, hand soap and tissue products. Cleaning agents must meet EU Ecolabel criteria 1 and 4 for hard-surface cleaners; products without the Ecolabel require a conformity audit by a conformity assessment body or independent auditor. Hand soap must meet the applicable EU Ecolabel criteria for rinse-off cosmetics, supported by an ecolabel certificate or equivalent audit. Tissue products must meet EN ISO 14024 Type I ecolabel requirements or an equivalent European standard, supported by a certificate or equivalent audit. Joint bidders must appoint an authorised representative and include the relevant power of attorney.
